Dear Mr. Pifer:

On December 16, 2008, a compliance inspection was conducted at the subject site with Amanda
Jones of the Army Corp of Engineers and your consultant, Chris Huysman. In a review of the dam and
the downstream installation of riprap, it appeared that more was placed in the stream than was approved.
A review of our files show that approximately 50 additional feet of riprap had been placed in the channel
(see enclosed figure). Also, once the stream discharges from the pond, it flows through the riprap, not
over it. Typically, one would expect sediment from upstream to fill the voids in the riprap, but in this
case the pond acts as a sink or sediment trap, storing any sediment in the pond rather than it moving down
stream. Finally,'additional plantings are required in the buffer areas.

For the additional stream impact due to the riprap installation you may remove the riprap or pay for
an additional 50 ft. of stream impacts to the EEP. How to correct the problem of the stream flowing
through the riprap rather than over may be more problematic. It may be possible to bring in a soil blend
that could fill the voids. I recommend that you work with Mr. Huysman to determine the best plan of
action
