Dear Mr. Sugg:

This letter is a follow up to my letter dated November 6, 2008, with respect to
Action I.D. 200200769 and Lot 113 Dolphin Ridge. Pursuant to my prior letter, Nassau has
commenced and completed the fill work on Lot 113 Dolphin Ridge. Once I receive the "As
Built" survey from the surveyor on Lot 113 Dolphin Ridge, I will forward it to you. If you have
any questions about the work or if I need to submit anything else to you at this time to document
the completion of the work, please let me know. Nassau recognizes that it still has the
responsibility of monitoring the mitigation work on Lot 121 Dolphin Ridge to confirm the
mitigation is successful.
