Wilmington Street Raleigh, North Carolina 27601 Subject: Clarification of Fish Tissue Monitoring Report Requirements for NPDES individual stormwater permits Dear Mr. Langley: In response to your request dated July 13, 2017, we are sending clarification of the stormwater NPDES permit requirement for reporting of fish tissue monitoring data. As you noted in your letter, this is a follow up to our joint meeting with you and representatives from NPDES Wastewater and Water Sciences Programs in the Division of Water Resources (DWR) on April 18, 2017. NPDES individual stormwater permits for several Duke Energy plants require the permittee to submit a copy of fish tissue monitoring results to the DEMLR Stormwater Program "within 30 days of receiving results." This language is contained in the following NPDES Stormwater Permits: Asheville Steam Electric Plant — NCS00095--/-- 575 Belews Creek Steam Station — NCS000573 Cape Fear Steam Electric Plant — NCS000574 Dan River Combined Cycle Station — NCS000572 Marshall Steam Station — NCS000548 Mayo Electric Generating Plant — NCS000580 Riverbend Steam Station — NCS000549 Roxboro Steam Electric Plant — NCS000581 W.H. WeatherspoonPlant —NCS000589 We understand that fish tissue analysis reporting requirements in companion wastewater permits for these facilities allow a necessary time delay between fish tissue sample collection and analysis because of the long process involved, and because those requirements dictate how reports are presented. Therefore, for individual stormwater permits with this language, "results" may be interpreted as the completed fish tissue data analysis report. If the final report is not yet complete because the wastewater permit reporting timeframe is not aligned with the stormwater permit renewal, the permittee should submit available fish tissue data to the DEMLR Stormwater Program at the time of the permit renewal application. Subsequent data should be submitted to DEMLR at the time of the wastewater permit application to DWR.
