Comments are provided below: Maple View — Monitoring Year 1 Report DWR Comments The Division of Water Resources has reviewed the Year 1 Monitoring Report received September 15, 2017 and has the following comments: 1. Encroachment within 0.23 acres (10,018.8 ft2) along the easement boundary in the "Replant Area" — Despite the Figure 5 (see attached) noting only the marker poles were missing, the pictures suggest mowing of the area as well. When comparing the photos taken this Spring of the "replant area" with those taken during monitoring, it appears that the trees that were planted in Spring 2017 were mowed and their heights greatly affected by the encroachment. Poles appear to be missing as well. EBX is not proposing a replant of this area. Action Item 1: Add two rectangular transects to the mowed area identified as "Replant Area" on Figure 5 and submit vegetation data for each transect. Length and size of the transects are up to the discretion of EBX, but they must be placed in the encroached area along the boundary as shown. Only the quantity, species type and heights of planted woody stems in the transect need to be presented. This data shall be provided to DWR as a response to this report review. Additionally, these two transects will need to stay in place and be presented with the Year 2 Monitoring Report in addition to the other plot data. Action Item 2: EBX proposes replacing marking poles. However, DWR is unclear of what "poles" implies. Due to the nature of the encroachment and the location being along the edge of the easement boundary, it would be best if EBX invests in poles or wire fencing/T-posts as a means of more permanent marking. This would help ensure the boundary is clearly marked. 2. Encroachment within 0.10 acres (4,356 ft2) near Plot 7— Action — Action Item 3: EBX is proposing replanting the area in 2018. DWR supports this action. Action Item 4: Due to the nature and location of the encroachment it would be best if EBX invests in poles or wire fencing/T-posts as a means of more permanent marking. This would help ensure the boundary is clearly marked and any replanting that is performed is less likely to be hindered in the future. As a result of the monitoring report review, DWR will hold the next credit release until the Action Items 1, 2 and 4 are implemented and EBX submits proof of work in writing to DWR.
