December 8, 2008 Ms. Annette Lucas NC Division of Water Quality 2321 Crabtree Boulevard, Suite 250 Raleigh, North Carolina 27604 Re: Briar Chapel Community Phase 5 South - Chatham County, NC NEW-06030 Stormwater Management Plan Modification Request: DWQ Project # 05-07320 Dear Ms. Lucas: On behalf of Newland Communities, we are requesting a modification to the existing Stormwater Management Plan Approval (see DWQ project number referenced above) for Phase 5 South of the Briar Chapel Community that was approved as part of the 401 Water Quality Certification. The project is located off US Highway 15-501, north of Andrews Store Road and south of Mann's Chapel Road in Chatham County, North Carolina. APPROVED DESIGN The proposed development is located within the Cape Fear River Basin, and drains to streams (Pokeberry Creek & Wilkinson Creek) classified as Water Supply IV (WS-IV), and Nutrient Sensitive Waters (NSW). As a result of the proposed development exceeding the maximum allowable limit for stream/wetlands impacts, an individual permit was issued by The United States Army Corps of Engineers (USACE). Also, a Clean Water Act Section 401 Water Quality Certification from NCDWQ was issued with the individual permit. Under the 401 Water Quality Certification from NCDWQ, Newland Communities was required to submit final stormwater management plans that utilized constructed wetlands, bioretention areas, wet ponds followed by forested filter strips and similar best management practices designed to remove at least 85% TSS. As a result, a courtesy notification (along with the revised site layout attached) was provided to the DWQ detailing both drainage area and impervious area changes to the June 2008 wet pond approval. The courtesy notification did not propose any structural changes to the June 2008 wet pond approval for Phase 5 South. PROPOSED REVISIONS Rather than construct the entire approximately 22-acre Phase 5 South at one time, the owner has decided to divide the construction into two parts: Phase 5 South `A' and Phase 5 South `B'. Phase 5 South `A' will be the initial stage of construction involving approximately 9.8-acres and will consist of 28 single-family residential lots, along with the associated utility and roadway infrastructure (see Site Plan for more detail). Phase 5 South `B' will be constructed sometime in the future (potentially several years) and will involve the construction of the remaining portions of the overall Phase 5 South. The wet pond approved in June 2008 designed to treat the entire 22-acre Phase 5 South area will be constructed in the future as part of Phase 5 South `B'. This has resulted in the requirement that a temporary stormwater best management practice be constructed for the time being to serve as water quality treatment for Phase 5 South `A' until the wet pond approved in June 2008 is constructed sometime in the future as part of Phase 5 South `B'. Once construction of Phase 5 South `B' including the previously permitted wet pond is complete, the temporary stormwater best management practice serving Phase 5 South `A' will be removed.
