Thank you for your recent assistance with this Audubon Villages project. We are
pleased to submit the following project information to you for US Army Corps of
Engineers (COE) 404 and NC Division of Water Quality (DWQ) 401 approval. After
discussions and meetings with you and project staff, we have addressed the items
referenced below.
Jurisdictional Wetland Avoidance & Minimization:
Additional wetland avoidance was accomplished by redesigning the commercial
shopping center. The majority of the proposed impacts (3.75 Ac.) are associated with
Wetland Impact One in the front area of the proposed Retail Center on Harkers Island
Road. Wetland Impacts Two (0.12 Ac.) and Three (0.01 Ac.) are associated with
Skylark Avenue and the rear Service Drive, respectively. Please refer to attached
Audubon Villages engineering plans and Skylark Avenue road placement report. The
last plan sheet (W-1) details the proposed wetland impacts. Plan Sheet D-2 illustrates
the retaining wall planned for these two areas to minimize impacts. The small wetland
area (0.5 Ac.) immediately north of Skylark Avenue has been avoided through
redesigning that office/retail area. Through these above efforts, the proposed wetland
impacts have been reduced to 3.88 Acres and 7.22 Acres will be preserved.

DWQ Comments:
We are submitting the additional information that we received on November 19, 2008
requested from written correspondence on November 14, 2008. We have addressed your
included written comments in the following paragraphs.
1. Please re-submit your site plans on full plan sheets at a scale of no
smaller than 1 "-50' with topographic contours shown.
Please refer to the attached engineering plans. They include the following
sheets:
C-2: Phasing plan and lot build upon area exhibit.
C-8 to C-15: 60-scale details of the proposed residential and commercial
sites with existing and proposed topography.
C-36: Overall plan (not-to-scale) of proposed residential and commercial
sites.
D-1: Commercial site stormwater plan. The proposed BMP areas are
located adjacent to Skylark Avenue. Stormwater will be conveyed from
the commercial site to these areas. This will be done by pumping the
stormwater through the Skylark Avenue right-of-way to reduce
permanent/temporary wetland impacts.
D-2: Exhibit detail of retaining wall and transition areas.
S-1: Commercial site plan (50-scale) south.
S-2: Commercial site plan (50-scale) north.
W-1 Commercial site plan (50-scale) with proposed (3) wetland impact
areas.
2. Please provide building envelopes for all lots with wetlands on the
site plans.
Please refer to Sheets D-1, S-1, S-2, and W-1 for details of the proposed
commercial site and the wetland areas.
3. Please indicate proposed lot layout as an overlay on the site plan.

4. The DWQ will not allow your proposed replacement of native soils
with non-native soils to facilitate your proposed stormwater BMP
plan.
We understand your concern regarding the soil replacement. EDA staff is
currently coordinating with DENR staff regarding stormwater treatment. Upon receiving
401 approval for the proposed wetland impacts, detailed stormwater plans and details
will be finished and submitted to the appropriate parties.
5. Please provide an inventory of impervious surfaces in each drainage
area.
Please refer to the attached Water Management Calculation Worksheets and
Sheets S-1, and S-1 for a breakdown of the drainage areas. Ms. Mary J. Naugle is
currently reviewing the stormwater plans for Phase one and other involved areas and
coordinating with EDA personnel. The southern retail area is proposed to have 6.85
Acres (50%) BUA. The northern retail area is proposed to have 2.90 Acres (53%) BUA.

Re: Skylark Avenue Location:
Mr. Keller,
The location of Skylark Avenue was determined from guidelines for roadway design
established by NCDOT to provide a minimum distance of 150' from existing
driveways/intersections and proposed driveways/intersections. Due to the anticipated
volume of traffic and size of the proposed intersection EDA expects NCDOT to strictly
enforce the 150' minimum distance. We evaluated a number of alternative roadway
layouts for Skylark including along the northern property line of Commercial Tract Two,
along the northern property line of the Parker Tract and the proposed location. Upon
evaluation we determined that the proposed location best meet NCDOT requirements,
minimized noise and traffic impacts on adjacent land owners and limited wetland
impacts to less than Y4 acre for the roadway. Further, NCDOT has reviewed and
accepted the alignment at two reviews (Sketch Plan Technical Review and Preliminary
Plat Technical Review).
