APPROVAL OF STORMWATER MANAGEMENT PLAN MODIFICATION
Dear Mr. Smith:
On July 21, 2007, the Division of Water Quality (DWQ) issued a 401 Water Quality Certification to
impact approximately 2,703 ft2 of Zone 1, 1,770 ft2 of Zone 2 of the protected riparian buffers, and 45
linear feet of perennial stream for the purpose of constructing the commercial development at the subject
property as described within your application dated July 2, 2007.
On November 12, 2008, the DWQ approved a revised stormwater management plan, dated November 7,
2008, for this project submitted by the consulting engineer Freeland and Kauffman, Inc. This revised
stormwater management plan has been reviewed and satisfies the stormwater management requirements
of the 401 Water Quality Certification.
The structural stormwater practices as approved by DWQ as well as drainage patterns must be maintained
in perpetuity. No changes to the structural stormwater practices shall be made without written
authorization from the DWQ. Stormwater easements shall be recorded for a distance of at least 10 feet on
each side of all storm water conveyances on all lots containing these structures including future access for
maintenance. The stormwater easements shall allow for the ability to maintain the structures, perform
corrective actions as described above and shall provide protection of the structures from potential
alternations by future property owners.
