Macon County PIN No. 7523003715 NOV-2017-DV-0227 Discharge to waters of the State without a Permit Dear Mr. Dunahm: On August 30, 2017, staff from the Asheville Regional Office (ARO) of the Division of Water Resources (DWR) conducted a site inspection of the subject property near Franklin, North Carolina. During the site inspection, DWR staff observed two white PVC pipes actively discharging wastewater to the ground and into the Cullasaja River. The following violation was identified: VIOLATION I. Discharge without a permit — North Carolina General Statute (hereby known as G.S.) 143-215.1(a)(1) requires that no person shall make any outlets into the waters of the State unless that person has received a permit from the Commission. REQUIRED RESPONSE You are required to take immediate action to correct the violation noted above and to provide an initial written response within 10 days of receipt of this Notice. Your initial response should describe the immediate corrective actions you have taken to address and prevent the discharges. Within 30 days of receipt of this Notice, you should provide a response that details your plan to address the long-term management of wastewater at the subject property. If no response is received in this Office within the 10 -day period, a civil penalty assessment may be prepared. Remedial actions should have already been taken to correct this problem and prevent further occurrences in the future. The Division of Water Resources may pursue enforcement action for this and any additional violations of State law. Reminder: Pursuant to Permit Condition 6 in Section E'the Permittee is required to verbally notify the Regional Office as soon as possible, not to exceed 24 hours, from first knowledge of any non-compliance at the facility including limit violations, bypasses of, or failure of a treatment unit. A written report may be required within 5 days if directed by Division staff.
