In order to provide safe access and interconnection to the site, access roads and four crossings are necessary. To facilitate development of the site and construction of the proposed stream crossing, grading the site is necessary. D. Impact Justification and Mitigation 1. Avoidance and Minimization 1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. Due to the development and use of the site as a solar farm, access roads and four WoUS crossing are necessary. The road widths have been designed to the minimal width necessary to safely accommodate heavy equipment and tractor trailers. Crossings 3 and 4 have been designed to cross in locations of existing culverts, thus minimizing impact to streams and open water drainage ditches located on the site. The four crossings will utilize head/end walls and a 3:1 side slope which further minimizes impacts to streams, wetlands and open water drainage ditches. The solar array and necessary infrastructure (overhead/underground voltage lines, inverters, etc.) have been designed to avoid impacts to jurisdictional streams, wetlands and ponds. There are approximately 6.25 acres of wetlands, 21,000 linear feet of perennial stream channel, 0.25 acres of open water ponds and 0.50 acres of open water drainage ditches located on the site. The open water ponds will be avoided. The remaining approximate 6.22 acres of wetlands, 20,978 linear feet of perennial stream and 0.49 acres of open water drainage ditches are being avoided. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. The impact limits will be staked and silt fence will be used. Temporary coffer dams will be installed up -gradient of the proposed culverts. During construction, water will be pumped around the construction footprints. Appropriate bank protection will be provided in the channel during construction and all excess excavated material will be immediately removed from the crossing areas. Upon completion of the culvert installations, the temporary sand bag coffer dams will be removed and flow will be diverted through the culverts. Following construction, disturbed banks will be restored to similar pre -construction conditions, matted and seeded live staked. 2. "Therefore, if you have projects that occur within the Raleigh Field Office's area of responsibility (see attached county list), you no longer need to contact the Raleigh Field Office for a list of federally -protected species. Based on the information provided and other information available, it appears that the proposed action is not likely to adversely affect any federally-listed endangered or threatened species, their formally designated critical habitat, or species currently proposed for listing under the Act at these sites. We believe that the requirements of section 7(a)(2) of the Act have been satisfied for your project. Please remember that obligations under section 7 consultation must be reconsidered if: (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered; (2) this action is subsequently modified in a manner that was not considered in this review; or, (3) a new species is listed or critical habitat determined that may be affected by the identified action. However, the Service is concerned about the potential impacts the proposed action might have on aquatic species. Aquatic resources are highly susceptible to sedimentation. An erosion and sedimentation control plan should be submitted to and approved by the North Carolina Division of Land Resources, Land Quality Section prior to construction. In addition, we recommend maintaining natural, vegetated buffers on all streams and creeks adjacent to the project site. In general, the Service recommends that solar facilities be sited in areas that are previously disturbed, or sites that do not impact mature forest, wetlands, or streams. The project tract is located along Brown Hodges Road west of the intersection with Jack Quinerly Road in Grifton, North Carolina. The geographical setting of the project is considered a high probability area for archaeological remains, particularly those associated with prehistoric Native Americans. The Buckleberry Solar project tract has never been systematically surveyed for archaeological resources. Given the nature of this landscape and the high probability of Native American remains, we .recommend a Phase I/II archaeological survey of the tract considered as part of this application. As a result, we recommend the following conditions for this application: Prior to initiation of any ground disturbing activities within the project area, the applicant shall arrange for an archaeological survey of the entire project area. The purpose of this survey will be to locate archaeological sites and make recommendations regarding the eligibility status of each site in terms of the National Register of Historic Places (.NRNP). If a site is determined to be eligible for the NRHP the applicant shall determine whether the site will be adversely affected by the project activities; and, if so, develop and implement an appropriate mitigation plan. Two copies of all resulting archaeological reports, as well as one copy of the North Carolina site forms, should be forwarded to the Office of State Archaeology through this office for review and comment as soon as they are available and in advance of any construction or ground disturbance activities. A list of archaeological consultants who have conducted or expressed an interest in contract work in North Carolina is available at www.archaeolQgy.ncdcr.gQv/ncarch/resource/consultmits.htm. The archaeologists listed, or any other experienced archaeologist, may be contacted to conduct the recommended survey.
