DEED
THIS DEED is made this ! day of January 2017 by and between THE ASHE
COUNTY BOARD OF EDUCATION, a body politic and corporate existing under the laws
of North Carolina, hereinafter designated Grantor, and FLEETWOOD VOLUNTEER FIRE
AND RESCUE DEPARTMENT, INC., a North Carolina non-profit corporation, hereinafter

designated Grantee. The address of the Grantee is P. O. Box- Fleetwood, North
Carolina 28626. The designation Grantor and Grantee as used herein shall include
said parties, and their respective successors, and assigns, and shall include
singular, plural, masculine, feminine or neuter as required by the context.
WITNESSETH:
The Grantor, for valuable consideration, the receipt and the sufficiency of
which are hereby acknowledged, does hereby grant, convey, and confirm to the
Grantee in fee simple the tract (a) or parcel (s) of real property located in Pine
Swamp Township, Ashe County, North Carolina and described on attached EXHIBIT A.
TO HAVE AND TO HOLD the tract(s) or parcel(s) of real property described on
attached Exhibit A and all privileges and appurtenances thereto belonging to the
Grantee in fee simple in such full and ample manner as the Grantor is authorized
and empowered to convey.
The Grantor covenants with the Grantee, that Grantor has done nothing to
impair such title as Grantor received, and Grantor will warrant and defend the
title against the lawful claims of all persons claiming by, under or through
Grantor, except for any exceptions or matters herein stated.
The real property described herein is conveyed subject to the following
exceptions:

1. Encroachments, overlaps, deficiency in quantity of ground, boundary line
disputes, roadways, unrecorded easements, and any other matters that would
be shown by an accurate survey and physical inspection of the herein
conveyed property;
2. All covenants, terms, restrictions, conditions, contracts, provisions,
reservations, and other matters of record in Ashe County, but only to the
extent that the same are still in effect;
3. Zoning requirements, statutes, rules, orders, restrictions, regulations
and ordinances of governmental agencies or their instrumentalities
relating to the herein conveyed property, the structures located thereon,
their construction and uses, in force on the date hereof (if any such
exist);
4. All highway and other roadway rights-of-way and easements including, but
not limited to, the right-of-way of U. S. Highway 221 South;
5. All other easements and rights-of-way;
6. Ad valorem taxes, if any.
The herein conveyed property (including all structures and improvements
situated thereon) is being sold and transferred in its "as is" condition and
"where is" location and, further the Grantor makes no representations or
warranties concerning the condition or location of the property.
IN WITNESS WHEREOF, the Grantor has duly executed this Deed the date stated
above.

PROPERTY DESCRIPTION
Conveyed hereby is the Fleetwood Elementary School property (land and
improvements) containing approximately 3.8 acres, located on U. S. Highway 221
South, and identified by the Ashe County Tax Office as Parcel ID 15235 083. The
Grantor is informed and believes that this property is composed of those parcels
described on the following Deeds recorded in the Office of the Register of Deeds
in Ashe County: Book A2, Page 360; Book A2, Page 381; Book B2, Page 292; Book
J1, Page 233; Book J1, Page 234, Book J1, Page 235; Book J1, Page 236; Book Z1,
Page 26; Book N2, Page 519; Book S3,Page 102. The description contained on each
of these deeds is incorporated herein by reference.
