Tryon Street 13s' Floor Charlotte, NC 28285-0107 Project: Rocky River Landing County: Concord The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NCEEP) is willing to accept payment for impacts associated with the above referenced project. Please note that this decision does not assure that the payment will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact these agencies to determine if payment to the NCEEP will be approved. You must also comply with all other state, federal or local This acceptance is valid for nine months from the date of this letter andis not transferable. If we have not received a copy of the issued 404 Permit/401 Certification/CAMA permit within this time frame, this acceptance will expire. The multi-family residential project is in the vicinity of Concord Mills Boulevard and near Exit 49 of Interstate 85. Proiect Information 1. Name of project: Rocky River Landing - Phase 2 2. Location: Cabarrus County Nearest Town: Concord 3. Property Identification Number: Portion of 4589755666; Portion of 4589765814 4. Directions: From Exit 49 of Interstate 85 - west on Concord Mills Boulevard; north on Thunder Road. 5. Site coordinates: 35.3796°N, 80.7251°W (WGS84/NAD83); USGS Harrisburg 2 6. Property Size:- 81.1 Acres 7. Name of nearest receiving body of water: Rocky River and UT of Rocky River - HUC 03040105 8. River Basin: Yadkin 9. Existing Conditions: The development project site is a previously graded, flat disturbed site with steep side slopes to the large wetland and riparian areas in the floodplain. The project vicinity is experiencing rapid economic growth due to it's proximity to Interstate 85; Lowes Motor Speedway; Concord Mills Mall; Concord Regional Airport; Kannapolis Research Park; and other commercial large employment centers. Rocky River Landing is partially constructed with Phase 1 of the project which includes a proposed Wal-Mart SuperCenter and a Multi-Family Project. Although there is currently a downturn in single family residential development, the commercial and multi-family apartment sector of the economy remains relatively strong. Phase 2 consists of +/- 20.73 acres of area that is proposed to be developed. The undeveloped areas of the site consist of +/- 60 of wetlands and adjacent riparian area. Approximately 44 acres or the 60 acres are wetlands in the Rocky River floodplain. 10. Overall Project Description: The proposed project is a multi-family project consisting of apartment buildings, interior roads, parking lots, and required stormwater management facilities. An access road from Concord Mills Boulevard is necessary to access Phase 2. The access road is aligned with an existing signalized intersection. 11. Purpose of Proposed Work: Impacts to streams and wetlands are required to access the development site from Concord Mills Boulevard. Access is required from Concord Mills Boulevard in order to meet City of Concord zoning requirements. The proposed stream impact (currently submerged due to beaver activity) is approximately +/- 150 linear feet. The proposed permanent wetland impact is proposed not to exceed 1 acre. 12. Proiect History: A permit for the Phase 1 stream and wetland impacts were issued by the USACE (Action ID. 2008-0531) and NCDENR - DWQ (DWQ # 07- 0076V2). Mitigation for the permitted impacts was provided to the NCEEP. In addition the developer removed a large temporary road crossing on an adjacent property. The application for a Nationwide Permit #39 submitted in January 2007 indicated that a future phase was anticipated and that additional impacts would be required. Preliminary wetland and stream evaluation and delineations were conducted in conjunction with project planning. Wetland Delineation was conducted by ECS and Leonard S. Rindner, and verified by Amanda Jones and Steve Lund of the USACE. 3 The wetland conditions continue to change based on beaver activity. A pre-application meeting was held with Amanda Jones of the USACE and Alan Johnson of NCDENR on April 26, 2006 to review the site planning, traffic, and proposed wetland and stream impacts proposal. This meeting included representatives of the developer, engineers and planners. The initial proposal included over 6 acres of wetland impacts and over 600 linear feet of stream impacts. Based on the results of that meeting the site plan was modified to remove several proposed out-parcels along Concord Mills Boulevard and the access road to minimize wetland and stream impacts. Due to project scheduling and commitments the project is being developed in two phases. Phase 1 included a commercial development and the first phase of the multi- family component of the development and access by an extension of an existing road called Thunder Road. Phase 2 included an additional road crossing from Concord Mills Boulevard and Phase 2 of the Multi-family Residential Development. The two road crossings are required to meet City of Concord zoning requirement; avoid traffic congestion; safety concerns for residents and pedestrians; access for emergency vehicles and other public services. The City of Concord requires a minimum of two access drives be provided for multi- family developments of 100 dwelling units or more. (See Article 7.8.5 A of the City of Concord Unified Development Ordinance). Due to existing site conditions and limited frontage on Thunder Road, the connection to Concord Mills Boulevard via the wetland crossing is required to provide the second access point into the site. This second access point will serve as the only full access driveway into the development for residents, emergency vehicles, and school buses. It was anticipated that the future Phase 2 road crossing would require an Individual Permit based on a preliminary application review with the USAGE. Except for the road crossings other streams and wetlands are not anticipated in Phase 2 of the project except for the proposed road crossing. It was also anticipated that the Individual Permit Application for Phase 2 would include a proposal to preserve the remaining wetlands, streams, riparian areas, and other adjacent upland natural habitat areas within a conservation easement or similar protective mechanism. Additional pre-application meetings were held with Steve Lund of the USACE and Alan Johnson of NCDENR through the preparation of this application and supportive documentation prior to submittal. 13. Future Project Plans: Additional stream and wetland impacts are not expected for the project. 14. Proposed Impacts to Waters of the United States/Waters of the State: Proposed impacts are approximately 150 linear feet of perennial stream (currently submerged by beaver dams) and approximately 1 acre of wetlands. 4 15. Avoidance and Minimization Analysis: In order to access the site from the signalized intersection on Concord Mills Boulevard to provide access for vehicles and pedestrians; provide access for emergency vehicles; police and fire protection; trash collection; school buses; and other services; construction of a road roadway is required. The location of the access road is aligned with an existing signaled intersection on Concord Mills Boulevard. A bridge alternative was evaluated. If a bridge is proposed, earthen approach embankments would need to be constructed on each end of the bridge deck and will impact the existing wetlands. Due to the existing topography the approach on the Concord Mills Boulevard approach would be significant. Based on extremely saturated soil conditions, the bridge will likely need to be supported on a deep foundation system, such as driven steel piles. The driven pile foundations needed for bridge support would also require an impact/disturbance in order to construct a temporary access road across wetlands for mobilizing the pile driving equipment to the bridge foundation locations, especially any interior bends that may be required. To construct box culverts, an earthen embankment would need to be constructed. The impact to the wetlands will be dependent on the depth of fill required to achieve the proposed roadway elevation. Typically embankments are constructed with 2:1 or flatter slopes, with the top of the slopes approximately 5 to 10 feet behind the proposed curb. Prior to constructing the embankment, the existing wetland will likely require undercutting to remove marginal stability soils and provide a suitable base for placement of compacted structural fill. The preparation of the existing subgrade and subsequent embankment construction will impact the wetlands to the extent of the width of the embankment. It is anticipated that this would have required approximately 1.5 acres of wetland impacts. It is expected that there would be 5 to 6 box culverts. The box culverts will be placed by side essentially creating a stable bridge between embankments. To reduce the scope of impacts utilizing box culverts, several options were considered, including: - Surcharging the existing wetland subgrade to consolidate unstable soils and reduce the amount of undercut required (i.e. reduce the amount of disturbance to the existing wetlands). With this option, the roadway can be surcharged past the proposed box culvert and the remaining portion left open to allow water flow. Then when surcharging is complete on that portion, the box culvert can be installed and the remaining length can be surcharged, - The width of the embankment may be reduced by utilizing steeper reinforced slopes, possibly achieving a stable 1.5 to I or steeper slope. This option will be dependent upon the embankment supporting materials and the proposed fill 5 material to be used for constructing the embankment. It is expected that this technique will allow impacts to be reduced to approximately 1 acre of impacts. For either type of proposed crossing, geotechnical subsurface data will be needed for design (deep foundation design for bridge support or evaluation of settlement potential of constructed embankments). To obtain the necessary subsurface data, soil test borings will need to be performed along the length of the proposed roadway. In order to obtain the necessary subsurface data, an access road will need to be constructed by building a soil bridge across the proposed roadway area. Construction of this access drive will likely consist of placing 2 to 4 feet of onsite materials along the proposed roadway alignment to provide a stable working base for an ATV mounted drill rig. The soils consultant has explored other options of accessing the proposed boring locations, including performing hand auger borings, installing temporary construction mats or utilizing a barge mounted drill rig. Hand auger borings are not feasible due to limited depth of subsurface data that can be obtained (wet subsurface conditions typically lead to shallow cave in of the hole when performing hand auger borings). Based on their correspondence with various subcontractors specializing in mat systems and barge mounted drill rigs, these options would be extremely difficult to implement with the existing wetland conditions. Based on the above noted information, it is the opinion of the soils consultants that disturbance of the wetlands within the extents of the proposed roadway alignment will be required with either of the construction alternatives. 17. Minimization Alternative Site Analysis Original design for the road crossing included 2:1 slopes impacted approximately 1.5 acres of wetlands. To reduce impacts soil stabilization techniques will be proposed to reduce impacts to 1 acre by increasing slopes to a 1:5 to 1 slope. In addition, the City of Concord agreed to reduce the width of the normal road section and to limit the sidewalk requirement to one side to reduce width of the fill. The developer is also proposing that this access road be private to allow flexibility in construction and slopes in lieu of standard design requirements. Reduction of scope was also not considered feasible for the development of the Subject Property. In order to avoid the stream and wetlands the development would be required to not construct the access road and therefore could not meet City of Concord Zoning Ordinance. In addition, there would be conflicts between commercial, residential, and pedestrian traffic. 18. DETERMINATION of NO PRACTICABLE ALTERNATIVE To balance the environmental consequences of these unavoidable impacts to surface 6 waters and wetlands the developer has proposed minimization measures and has proposed a compensatory mitigation plan and comprehensive stormwater management plan. The plan and facilities will be designed and engineered in accordance with Concord's Post Construction Ordinance. 19. Mitigation: The developer is proposing to mitigate for the proposed stream and wetland impacts through a contribution to the North Carolina Ecosystem Enhancement Program for 150 linear feet of stream impacts and 1 acre of wetlands. The remaining 60 acres of wetlands and riparian areas will be preserved and protected by Restrictive Covenants and/or a Conservation Easement. 20. Stormwater: A stormwater management plan will be developed in accordance with the City of Concord NPDES Phase 2 Post Construction Ordinance. Also the plan will incorporate aspects of the Natural Resource Management (NRMP) plan created by Audubon Environmental which include `sustainability' recommendations. Structural: Use of compost socks, grassed swales, filter strips, and stormwater wetlands; converting landscape beds in parking lots to rain gardens where feasible, pervious pavement where feasible, and that physical controls be added to drop inlets or junction boxes. Non-structural: Special management zones, no direct surface or direct sub-surface stormdrainage to environmentally sensitive areas (wetlands), appropriate turf grass, vegetated buffers of native plant materials, proper irrigation, slow release fertilizers. 21. Endangered Species and Cultural Resources Based on a field survey the proposed activity will not affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The project site was a completely graded site prior to the planning and development of this site. There are no indications of any existing structures or archaeological sites on listed on or potentially eligible for the National Register within the study area. According to the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, this site is not registered property or property listed as being eligible for inclusion in the Register. 22. Aquatic and Natural Habitat The aquatic systems in the project area consist of wetlands, and perennial tributaries of Rocky River, and Rocky River. A variety of wildlife is supported by these systems including mammals, birds, reptiles, amphibians, fish, insects, mollusks, and crustaceans. Therefore strict adherence to an approved erosion and sedimentation control plan will be maintained during the construction period in order to control degradation of water quality 7 downstream and protect the areas to be preserved. Impacts from hazardous materials and other toxins to fish and aquatic life such as fuels will be avoided by not permitting staging areas to be located near surface waters. The project is planning to work with Audubon International to develop a Sustainable Resource Management Plan. This plan requires the use of native plants whenever possible. This practice accomplishes a variety of positive goals, including: • Providing animals with the same food and cover plants they evolved with; • Minimizing the need to supply extra water, fertilizer, cultivation, and other care; • Reducing the need for pesticides because plants are co-evolved with local pests; • Maximizes plant and animal diversity. 26. Conclusion The requested permit has considered an evaluation of the probable and cumulative impacts and its intended use on the public interest. Based on a comprehensive analysis we believe that this proposal complies with the Environmental Protection Agencies' 404(b) (1) guidelines. The economic benefits of this project have been balanced by a mitigation plan to minimize and balance the environmental consequences. The proposal reflects the national concern for both the protection and utilization of important resources. Relevant factors included in the proposal include general environmental concerns, wetlands, cultural values, fish and wildlife values, land use, water quality, considerations of property ownership, and in general, the needs and welfare of the people. The development will provide important economic benefits to the region. Based on the value of the jurisdictional waters and wetlands on this site the developer has chosen to balance the site's economic viability with its environmental value. The goal of the proposed stormwater treatment and mitigation measures is to help balance the environmental consequences of this development.
