JAY ZIMMERMAN Director DWR # 2016-0716 Burke County Subject: REQUEST FOR ADDITIONAL INFORMATION Sherman's Hollow at Lake James (Lake James Development) Stormwater Management Plan Modification Dear Mr. Deal: On August 22, 2017, the Division of Water Resources — Water Quality Programs (Division) received a request for a modification to the approved stormwater management plan for the Sherman's Hollow at Lake James Subdivision. The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until all of the following information is received: On November 16, 2016 the Division issued a 401 Water Quality Certification written authorization for the Lake James Development for coverage under Water Quality General Certification Number 3890. Condition #3 of the authorization states that the Division approved the associated stormwater management plan (SMP) ... which specify a stormwater drainage system that consists primarily of vegetated swale conveyances. The modified stormwater management plan which is based on existing/as-built conditions of the site indicates a significant percentage of riprap lined swales. The Division does not consider riprap lined channels to meet the intent of the stormwater requirement of vegetated swales, regardless of whether some vegetation is present within the channel. The proposed SMP does not provide adequate calculations orjustification for the proposed riprap lined channels in lieu of vegetated swales/conveyances. While the Division recognizes that riprap is often necessary and appropriate for adequate erosion control during construction activities, upon project completion the channels must be restored to vegetative swales as approved. For significantly steep areas, riprap check dams may be used to slow the water in the channel, or the Division recommends that you consider reinforced turf or other supportive vegetative method of conveyance. The Division may approve alternative designs, such as minor areas of non -vegetated conveyances, when technical justification is provided and the alternative design does not compromise water quality protection. Please provide a stormwater management plan that includes proposed restoration of existing riprap lined stormwater conveyances to vegetated swales where calculations indicate that vegetated swales will be stable and provides additional justification for any existing swales that are proposed to remain lined with riprap. If all of the requested information is not received in writing within 30 calendar days of receipt of this letter, the Division will be unable to approve the application and it will be returned. The return of this project will necessitate reapplication to the Division for approval, including a complete application package and the appropriate fee.
