Sue,
Sorry to hit you with this project again, but I was hoping to close this NOV out sooner than later. You can read the email chain
for further clarification. I will plan a site visit in the coming weeks, but wanted to get your thoughts before I go. Maybe we can
talk on the phone after you have had a chance to look at Derek's email. A few questions that I have would be:
1. Do they need to resubmit for a modification to the stormwater plan?
2. Are the rip -rap swales okay?
3. There were some questions about when the deed restrictions needed to be signed and some of the lots have been
reconfigured but the BUA remains the same. This was low density by the way.
Burke County was not going to approve the final plats until we inspected the stormwater measures. This one is a little confusing
so we may need to talk. Thanks for your help.

Kevin,
I have attached the revised plan for stormwater. We essentially did an as -built of what was on site and ran it through
our spreadsheet to make sure the liners would work and the volumes are fine. I have been onsite during a couple of
events and the swales are working great. (Some Photos are attached) Many of the ones with Rip Rap in them have grass
growing through. Could we schedule a site visit for you to come out and take a look? I

I agree with that approach. Burke County has requested that we do an inspection to make sure that the stormwater management
plan has been implemented according to the plans. From my site visit on April 4, 2017, it does not appear that the plan has been
followed. Once we get a better idea of the modifications you can move forward with a submittal. After the plan has been
implemented, I will schedule a follow up inspection.

Derek,
I'd need to see a detailed site plan for the entire project with clear indications of where all stormwater from any BUA is/will be
collected (e.g. are there roof gutters directed to the roadside swales), are driveways graded towards roadside swales, etc and all
the swales on the property need to be shown. Then I'd need an analysis of which of the swales have riprap, which have a
combination of riprap and vegetation, and if any are completely vegetated. You may want to include a discussion of whether
you believe any of the swales that have riprap could sustain the removal of the riprap based on slopes etc. In the past we've
preferred rock check dams at specified locations to slow velocities rather than complete lining of the swale with riprap. Once I
have a better understanding of the entire picture I can determine DWR's position.
Since the project already has a 401 we will need to treat this as a modification to the approved SMP. If Kevin agrees you may
hold off sending the formal request until we get a little further along in making some decisions about DWR's position, but since
this is related to an NOV, I defer to the ARO to determine the required schedule for submittal of these items/documents.
I will have to look into the deed restrictions a little further and get back to you about that.

Thanks for the link.
Our main issue is that some of the vegetative swales have rip rap in them to handle erosive velocities. It seems
counter productive to remove that rip and and create an erosion problem, so we would like to over seed the rip rap
sections and achieve some vegetation rather than removing it. I am not sure what pictures you have received some of
the swales with rip rap have a significant amount of vegetation already while others do not. below I have highlighted
in red an excerpt that leads me to believe that DEQ has the ability to approve this method. What do you think?
The second issue is do we have to resubmit to show these areas of rip rap and be scrutinized for a review process or
can we just amend out application since we do not have a 401 yet? (Because of the NOV) Some of the lot lines have
changed and or recombined as well, but it will result in the same Max. BUA.
Additionally, When does the deed restrictions document have to be recorded? Is the document attached what you
want recorded? It seems as if it may be old and not applicable to the 401 stormwater program, but it was all I could
locate.

"REQUIREMENT 15A NCAC 2H .1003(2)(c): VEGETATED CONVEYANCES (c) Stormwater that cannot be
released as dispersed flow shall be transported by vegetated conveyances. A minimal amount of non -vegetated
conveyances for erosion protection or piping for driveways or culverts under a road shall be allowed by the
permitting authority when it cannot be avoided. Vegetated conveyances shall meet the following requirements: (i)
Side slopes shall be no steeper than 3:1 (horizontal to vertical) unless it is demonstrated to the permitting authority
that the soils and vegetation will remain stable in perpetuity based on engineering calculations and on-site soil
investigation; and (ii) The conveyance shall be designed so that it does not erode during the peak flow from the 10 -
year storm as demonstrated by engineering calculations."

Sorry that I missed your call this morning. Kevin let me know that you may be contacting me about this project. He
sent me a picture of the rip -rap lined ditches that have been installed within the subdivision. Any change such as
that will require an application for modification of the SMP (there's no fee for a modified SMP application). All
current SMP submittals/applications are being reviewed by the new stormwater rules and design manual. There is a
chapter, E-1, specific to Low Density. Please review the definition of low density and the chapter carefully and then
if you have further questions give me a call. I'll be in a conf. call 10-12 today. Here's the link to all the documents
you need.
