Sullins, Director ":- Division of Water Quality February 4, 2008 DWQ Project # 07-1826 Cabarrus County CERTIFIED MAIL: RETURN RECEIPT REQUESTED Mr. Barry James American Asset Corporation 3700 Arco Corporate Drive, Suite 350 Charlotte, NC 28273 Subject Property: Shoffner NC 73 Project REQUEST FOR MORE INFORMATION: STORMWATER MANAGEMENT PLAN Dear Mr. James: On January 31, 2008, the Division of Water Quality (DWQ) issued a 401 Water Quality Certification to fill or otherwise impact 262 linear feet of perennial stream and 837 linear feet of intermittent unnamed tributary to Irish Buffalo Creek in order to construct a retail center in Cabanas County, as described in your applicant received by the DWQ on January 14, 2008.. In order to meet Condition 4 of the 401 Certification for this project, a stormwater management plan, was received by the DWQ on January 10, 2007. The DWQ has determined that your stormwater management plan was incomplete as discussed below. Additional Information Requested: 1. The DWQ does not approve the use of the proposed slotted drain level spreader. These devices have proven problematic in their applications in North Carolina. If the applicant wishes to use a level spreader, then it should be designed per Chapter 8 of the NC BMP Manual. If the sole purpose of the device is to reduce velocities from the pipe outlet, a rip rap dissipater device would also be appropriate. In addition, if the applicant chooses to use a properly designed level spreader on this project, then he should use our more recent Level Spreader Inspection and Maintenance Form, available at: http://h2o.enr.state.tic.us/sufbmp forms.htm. 2. If the project is within the jurisdiction of Cabarrus County, then please provide a copy of the Phase II approval letter from the DWQ Stormwater Unit indicating that the proposed activity has an approved SMP and one copy of the approved SMP, including plan details, calculations and other supporting information. The DWQ will require the above additional information to finalize review of the stormwater management plan for the subject property.
