Dear Mr. Poupart, Mr. Tarr, and Dept. of Environmental Quality Leadership
In response to the issuance of your September 14 letter to Atlantic Coast Pipeline, LLC, we are gratified by the
obvious attention that the Division of Water Resources has paid to many of the concerns raised in public
comments on the 401 Water Quality Certification. We note that you have incorporated many of them in your
request for extensive additional information from ACP, LLC about activities that could impact NC waters
during and after construction of the Atlantic Coast Pipeline.
We believe that DWR had sufficient information about several key concerns, including: 1) the neglect of ACP,
LLC in its preparation of the 401 application and responses to previous requests, 2) the massive Environmental
Justice impacts of the proposed project, 3) the well documented lack for additional gas fired power plants that
would be supplied by the ACP, 4) and the adverse economic impacts on North Carolina ratepayers, to have
made a decision to deny the 401 certification for the ACP. However, we fully understand the agency's need to
exercise careful due diligence in its final decision. We look forward to continuing to supply information to DEQ
on key issues related to this unjustified and damaging proposed project.
