Atlantic Ocean, at 59th St. SE and East Oak Island Drive, Oak Island , as requested in the permittee's application dated 8/12/08. incl. attached plan drawings (8), 1-5 of 8 dtd. 3/24/08, 6 of 8 did. revised 8/13/08, & 7-8 of 8 dtd. 8/12/08 & AEC Hazard Notice dated 2/4/04 This permit, issued on November 24, 2008 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) Prior to the initiation of construction within the Ocean Hazard AEC, the permittee shall stake, and a Division representative shall approve, the first line of stable, natural vegetation and the corresponding small and large structure setbacks. In this case, the first line of stable natural vegetation is defined as the vegetation line that existed prior to the onset of the most recent large-scale beach renourishment project. These setback determinations shall replace those done at the time the permit application was processed and approved. Construction shall begin within sixty days of this determination or the measurement is void and shall be re-established. In the case of a major shoreline change within that period, a new setback determination shall be required before construction begins. 2) The two buildings, associated parking lot shall be located landward of the small structure setback line, as determined in Condition No. 1 of this Major Modification. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. A. .. ,<. ... - Funston Land & Timber, LLC & Food Lion LLC Permit #61-05 ` Page 2 of 4 ADDITIONAL CONDITIONS 3) All buildings in the Ocean Hazard Area of Environmental Concern (AEC) shall be on pilings not less than 8" in diameter if round or 8" to a side if square. s 4) All building pilings shall have a tip penetration greater than 8' below the lowest ground elevation under s the structure. For those structures so located on the primary dune or nearer the ocean, the pilings shall extend to 5' below mean sea level. 5) 15A NCAC 07H .0308(a)(1)(B) prohibits permanent erosion control structures within the Ocean Hazard Area of Environmental Concern (AEC). Therefore, in order to ensure compliance with this rule, the design of all retaining walls within the AEC shall be the absolute minimum necessary to retain the backfill material. In order to ensure compliance with this condition, the permittee is encouraged to coordinate final retaining wall design with Division of Coastal Management staff 6) Any structure shall be relocated or dismantled when it becomes imminently threatened by changes in shoreline configuration. The structure(s) shall be relocated or dismantled within two years of the time when it becomes imminently threatened, and in any case upon its collapse or subsidence. However, if natural shoreline recovery or beach renourishment takes place within two years of the time the structure becomes imminently threatened, so that the structure is no longer imminently threatened, then it need not be relocated or dismantled at that time. This condition shall not affect the permit holder's right to seek authorization of temporary protective measures allowed under 15A NCAC 07H.0308(a)(2). NOTE: In accordance with 15A NCAC 7H.0308(a), no new seawall or riprap revetments shall be allowed in the future should any structure become threatened from erosion. 7) In order to avoid unreasonable danger to life and property, all development shall be designed and placed so as to minimize damage due to fluctuations in ground elevation and wave action in a 100-year storm. Cantilevered decks and walkways shall meet this standard or shall be designed to breakaway without structural damage to the main structure. 8) Any building constructed shall comply with the North Carolina Building Code and the local flood damage prevention ordinance as required by the National Flood Insurance Program. NOTE: The building code or flood damage prevention ordinance may impose additional more restrictive requirements than the Division's standards for development in areas of environmental concern (AECs). 9) No excavated or fill material shall be placed at any time in any vegetated wetlands or surrounding waters outside of the alignment of the fill area indicated on the workplan drawing(s). NOTE: In order to protect hatchling loggerhead sea turtles, all lights on building faces, including balcony lights on the ocean side of all structures should be eliminated. Where ocean side lighting is required, alternatives include shading, screening, or replacing fixtures with modern alternative light sources should be utilized. Parking lots, streets, tennis courts, walkways, dune crossovers, pools and other areas requiring lights should be illuminated with light fixtures located close to the ground to minimize casting direct light on the beach and dunes. Funston Land & Timber, LLC & Food Lion LLC Permit 961-05 Page 3 of 4 ADDITIONAL CONDITIONS Sedimentation and Erosion Control Y NOTE: An Erosion and Sedimentation Control Plan may be required for this project. If required, t his plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to the Department of Environment and Natural Resources, Land Quality Section, 127 Cardinal Drive Extension, Wilmington, NC 28405. 10) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, sand fence, etc.). Stormwater Management 11) The N.C. Division of Water Quality approved this project under stormwater management rules of the Environmental Management Commission under Stormwater Permit No. SW8040112, which was revised on 1/22/08. Any violation of the permit approved by the DWQ shall be considered a violation of this CAMA permit. General 12) The N.C. Division of Water Quality (DWQ) has authorized the proposed project under General Water Quality Certification No. 3768 (DWQ Project No. 081289), which was issued on 11/21/08. Any violation of the permit issued by DWQ shall be considered a violation of this CAMA permit. 13) This permit shall not be not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 14) This Major Modification shall be attached to the original of Permit No. 61-05, which was issued on 5/10/05, as well as copies of all subsequent modifications, renewals and/or refinements, and copies of all documents shall be readily available on site when a Division representative inspects the project for compliance. 15) All conditions and stipulations of the active permit remain in force under this Major Modification unless specifically altered herein, including but not limited to the mitigation requirements of the active permit. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required, including but not limited to an Individual Permit from the U.S. Army Corps of Engineers, and/or a driveway connection permit from the N.C. Department of Transportation. NOTE: Future development of the permittee's property may require additional CAMA authorization.
