SUBJECT Pipe Replacement on SR 2884 (Harvest Lane), Gaston County
Dear Mr Lund
The North Carolina Department of Transportation proposes to replace a deteriorating pipe on SR
2884 (Harvest Lane) in Gaston County An existing 60-foot long, 54" CMP will be replaced
with a 60-foot long, 72" CMP with inlet and outlet headwalls Ten feet of riprap will be used at
the pipe inlet and outlet for structure stabilization The pipe and roadway is collapsing at the
outlet end and there is a concern for public safety, therefore, this project is considered an
emergency project and construction will commence immediately The existing pipe is on
3 8% slope and there appears to be a headcut -5 feet upstream , which appears to be currently
controlled by rock in the stream channel Based upon the steep culvert slope and the existing
upstream headcut, it is anticipated that the required pipe burial will result in upstream channel
destabilization, therefore, the new pipe will be placed on existing streambed grade The stream
is low flow stream with limited aquatic life Due to the existing site conditions, NCDOT
requests a waiver from the Regional Conditions 2(b) (e) permit depth specification for the
construction of this project.
A temporary cofferdam pumping system will be used to divert the stream around the
construction site as needed Upon project completion, areas affected by temporary cofferdam
system will be graded and restored back to pre-project conditions The scope of the work will
result in 10 teet of permanent impacts to an unnamed tributary to Crowders Creek, which is
classified as Class C Waters by the Division of Water Quality
The project area is not located within '/2 mile of a critical watershed area nor is SR 2884 a rural
or urban arterial, therefore, hazardous spill basins are not required Enclosed is a hazardous spill

This ,.office has conducted a GIS/field survey for the project for historical saes and
threatened/endangered species No saes listed on the National Register of Historic Places are
located in the \,icinity of the pioject nor did there appear to be any eligible structures There will
be no effect on effect on historical structures The federally listed species for Gaston County
(USFWS listed dated January 31, 2008) the bog turtle (C'lemmys muhlenbergn) and
Schwemitiz's sunflower (Hehanthur schwermtzii)
Natural Heritage Program records document the nearest bog turtle location approximately 11 5
miles north of the proposed project area Bog turtles are typically found in bogs, marshes, and
wet pastures The area is maintained residential yards There is no potential habitat within the
proposed project area T/SA species are not subject to Section 7 consultation, however, no
impact on this species is anticipated Natural Heritage Program records document the nearest
Schweinitz's sunflower location approximately 5 5 miles east of the proposed project area The
sunflower is usually found in upland open areas protected from shade or excessive competition
The area is maintained residential yards There is no potential habitat within the proposed
project area The proposed project will have NO EFFECT on the bog turtle (C'lemmys
muhlenbergu) or Schweinitiz's sunflower (Helianthm schtireinil.7n) species

Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads Also provide a detailed site plan showing property

Replacement of a failing 54", 60-foot CMP with a 72", 60-foot CMP with inlet and outlet
headwall and associated riprap for structure stabilization The existing pipe is on 3 8% slope
and there appears to be an existing headcut in the upstream channel It is anticipated that
burying the pipe one foot below the existing elevation will create further stream
destabilization, therefore, the proposed pipe will be placed on the same slope (on grade) as
the existing pipe Typical heavy equipment (trackhoe, backhoe, etc ) will be used for the
construction of this project

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible Also discuss how impacts
were minimized once the desired site plan was developed If applicable, discuss construction

in the channel upstream of the existing pipe therefore the proposed pipe will be placed on the
same slope (on grade) as the existing pipe to prevent further stream destabilization
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H 0500 mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams

USAGE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on January 15, 2002, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed Examples of mitigation that may be appropriate and practicable include,
but are not limited to reducing the size of the project, establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams, and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing Any application
lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete
