Dear. Mr. Mills:
The Division of Water Quality (DWQ) 401 Oversight and Express Review Permitting Unit has reviewed
a letter report dated August 13, 2008, prepared by Soil & Environmental Consultants, PA (S&EC),
regarding repairs conducted on the above-referenced project.
Based on the information presented in the August 13, 2008 letter, fairly significant repair activities were
conducted at this site, which were warranted based on the conditions of the stream observed by DWQ
personnel, as outlined in our December 3, 2007 letter.
Based on the level of repairs needed at this site, DWQ feels that an extension to the monitoring period is
warranted to ensure that a repeat of the degradation does not occur, and that the newly-planted
vegetation becomes successfully established.
The letter states that July 2008 through June 2009 represents the 5th monitoring year for the site. DWQ
has decided that the monitoring period will be extended for a minimum of two years, at which time the
stream and riparian zone conditions will be evaluated. DWQ reserves the right to extend the monitoring
period further if evidence of further erosion and degradation is noted.
According to the 401 Water Quality Certification and Buffer Authorization Certificate dated December
30, 2005, 133,660.5 square feet (approx. 3.07 acres) of buffer mitigation was required for impacts
associated with buffers at the Crabtree Crossing Parkway project.
As described in our December 3, 2007 letter, the quality of the riparian buffer restoration appeared
questionable based on our site visit. The August 13, 2008 S&EC letter did not appear to address areas
noted to be lacking woody vegetation, nor was the issue of insufficient buffer width addressed. As
stated in our previous correspondence, buffer restoration areas that are not 50 feet in width cannot
receive mitigation credit for Neuse riparian buffers.
