HomeMy WebLinkAboutNC0003441_Waiver of Monthy Reporting Requirement_20170831Water Resources ENVIRONMENTAL QUALITY ROY COOPER Governs MICHAEL S REGAN Secretaw S JAY ZIMMERMAN Du ecls August 31, 2017 Mr. Neal Willard Wise Developments, LLC P.O Box 804 Mount Airy, NC 27030-0804 Subject: Waiver of Monthly Reporting Requirement Wise Storage Solutions NPDES Permit NC0003441 Stokes County Dear Mr Willard: As stated by 15A NCAC 02B 0506(a)(1)(E), permittees must continue to submit monthly Discharge Monitoring Reports (DMRs) to the Division, even when there is no discharge from the facility during the reporting period The Director may waive this requirement during extended periods of no discharge Your request to cease submission of DMRs stated that you have "installed a septic tank to handle this location as it will be used for warehousing from this point forward" You statement was confirmed by the recent inspection report from Justin Henderson of the Winston-Salem Regional Office (WSRO) After reviewing your request and considering the recommendation of the staff of the WSRO, I have agreed to waive the requirement to submit monthly DMRs for the subject facility, effective September 1, 2017 The DMRs up through August 2017 should be submitted as usual Please be aware that your firm remains liable for any wastewater discharge from the facility. Should any discharge occur, the discharge must be monitored as required by permit NC0003441 Notify the WSRO of any pertinent developments that anse regarding wastewater treatment at this facility, especially if the treatment system is reactivated We strongly recommend that you plug the outfall line from the lagoon, and maintain the lagoon & dam as noted in Mr Henderson's inspection report [attached] Until the lagoon is emptied and properly deactivated, it remains a potential liability to you as the facility owner. Please note while requirements for operator visitation, monitoring and reporting are being waived during the period of no discharge, your firm [as permittee] is still required to pay the Annual Administering and Compliance Monitoring Fee that is associated with this and all NPDES permits Thank you for your cooperation in this matter. Mr. Henderson informed Mr. Willard at that time that the outlet assoicated with the treatment lagoon also needed to be "plugged" to eliminated future potential discharges On Aug 2, 2017 Mr. Henderson performed a follow-up visit at the subject facility. There was no evidence of dye in the treatment lagoon, which appears to verify that all wastewater has now been diverted to and treated by the subsurface system. Mr. Henderson noted at this time that the outlet to the treatment lagoon had not been "plugged". The WSRO regional office is satisfied that all wastewater generated by the subject facility has now been diverted away from all treatment components of the subject NPDES permit, and therefore do not have any objections to the permit being placed in "inactive" status. However, the Permittee should be aware that failure to "plug" the lagoon outlet pipe may lead to future discharges which would invalidate the "Inactive" status. The WSRO regional office also highly recommends that the dam/dike assosciated with the treatment lagoon be properly maintained to reduce risk of bypasses. Mr. Henderson observed some woody vegetation currently on the subject dam, which may compromise the dam's integrity Increasing the potential for a bypass event.
