Dear Sir or Madam:
On August 12, 2008, the Division of Water Quality (DWQ) received your application dated July 31,
2008, to fill or otherwise impact 0.5454 acres of 404/wetland (0.4932 acres permanent impact and 0.0522
acres temporary impact) and 87 linear feet of intermittent stream (28 linear feet permanent impact and 59
linear feet temporary impact) to construct the proposed residential subdivision at the site. On September
23, 2008,and October 30, 2008, the DWQ received additional information from you, however, the DWQ
has determined that your application remains incomplete and/or provided inaccurate information as
discussed below:
The Request for More Information Letter sent on October 24, 2008 stated, "For each proposed
BMP, please provide a completed BMP Supplement Form, with all the required items. The BMP
Supplement Forms are available at the following web site:
http://h2o.enr.state.nc.us/su/bmp forms.htm." Your most recent submittal for this project failed
to provide the Required Items Checklist portion of the BMP Supplement Form as well as
numerous required items.
2. Per NCAC 2B 15A: 0214. 1000, a "drainage area" is defined as "the entire area contributing
surface runoff to a single point." The drainage area map and impervious calculations do not
reflect an inventory of the impervious surfaces at every outfall as required.
For these reasons your permit application is hereby considered returned. Once you have redesigned
your project to address the problems and inadequacies with your application as it was submitted, you will
need to reapply for DWQ approval. This includes submitting a complete application package with the
appropriate fee.
Please be aware that you have no authorization under Section 401 of the Clear Water Act for this activity,
and any work done within waters of the state would be a violation of North Carolina General Statutes and
