Dear Ms. Witherspoon and Mr. Smith:
As requested in your October 13, 2008 Notice of Violation (NOV), Soil & Environmental
Consultants, PA (S&EC) has been engaged by Panther Rock, LLC to prepare a Stream
Restoration Plan for the referenced project site. In addition, further discussions between
S&EC, Panther Rock, LLC, the US Army Corps of Engineers and yourself has led to
S&EC preparing this NOV response.
Within the October 13, 2008 NOV, the following violations were listed and identified:
1) 401 Water Quality Certification Condition Violation
2) Other Waste (In-stream sediment)
3) Stormwater General Permit - NCGO10000 Violation
The remainder of this letter will respond to each item individually; the original request
will be in italics followed by our response:
1. Documentation depicting all jurisdictional features (e.g. steams and wetlands). A
description and quantification of the impacts to those jurisdictional features and your
plans to avoid further stream and wetland area impacts on the site.
The original, complete application was submitted to the USACE and NC DWQ on
August 23, 2007 with supplemental stormwater management plan approval from the
Town of Knightdale on September 10, 2007. The extent of jurisdictional features and
impacts to those features was detailed in that submittal package. The impacts

approved by NC DWQ on September 19, 2007 (statutorily approved by the USACE
on October 11, 2007 via e-mail correspondence) included 113 linear feet of
permanent and 30 linear feet of temporary impacts to streams and 0.046 acres of
temporary wetland impact. These impact details were quantified and illustrated in the
initial permit submittal. There was no Jurisdictional Determination issued for the
project, although the USACE did conduct a site visit in November 2006 to approve
the wetland and stream delineation map. Mr. Eric Kulz of the NC DWQ also
conducted a stream-determination site visit in November 2006.
On October 21, 2008, S&EC staff met with Ms. Crystal Amschler (USACE) to
conduct a site inspection. Field observations made by S&EC staff and Ms. Amschler
on October 21, 2008 are as follows:
Impact No. 1 (Sewer Crossing):
Permitted in 2007: Permitted impacts included 30 LF of temporary channel, 2,000
sq. ft. of Zone 1 buffer impact (of which 1,700 sq. ft. was wetlands) and 1,200 sq. ft.
of Zone 2 buffer impact (of which 310 sq. ft. was wetlands);
Observed in October 2008: Approximately 55 linear feet of rip rap and earthen fill
in the channel. There is approximately an additional 3 linear feet of sediment from
the end of the rip rap (downstream end) to the silt fence that was installed across the
stream. The clearing limits measured approximately 40 LF on either side of the
stream area. .
Impact No. 2 (Aerial Sewer Crossing):
Permitted in 2007: Permitted impacts included 2,600 sq. ft. of Zone 1 buffer impact
and 1,500 sq. ft. of Zone 2 buffer impact. No proposed stream channel impact;
Observed in October 2008: Approximately 23 linear feet of rip rap in the channel
under the aerial sewer line. There is also approximately 13 linear feet of earthen fill
in the stream channel associated with a temporary road crossing. No channel
excavation (as cited in the NOV) was evident at the aerial crossing.
Impact No. 3 (Road Crossing):
Permitted in 2007: Permitted activities included 113 linear feet of channel, 7,750 sq.
ft. of Zone 1 Buffer impact and 5,000 sq. ft. of Zone 2 Buffer impact;
Observed in October 2008: Approximately 113 linear feet of channel impact. The
pipes are 100 LF in length as described in the permit application. One notable change
is that the plans called for one, 60" RCP pipe. The applicant chose to install two, 48"
RCP pipes instead. The NOV cited erosion around the headwalls on both the
upstream and downstream ends of this crossing. As of our field visit, this erosion had
been corrected and stabilized. Additionally, the NOV cited that the culverts were
perched approximately 8 to 10 inches above the substrate of the stream channel. This
was not evident during our site inspection visit with the USACE. One floodplain
culvert was noted as well as one low or normal flow culvert which was installed at the
appropriate elevations (i.e. buried the required 1 foot). The NOV also cited sediment
deposition both upstream and downstream of the crossing. This was not evident

during the October site visit. The sediment that is present in the stream channel is of
the same type, texture and composition as that of the sandy fines found in stream
channel (i.e. it is not the clay-loam soils evident on the subject site). The NOV also
cited rip-rap both upstream and downstream of the culvert. During our site visit we
noted approximately 15 pieces of rip-rap on the upstream end of the crossing that
appeared to have been thrown into the stream by recent trespassers and vandals.
There was also rip-rap noted at the downstream end of the culvert that appears to
have fallen in from the banks of the channel.
Ms. Amschler of the USACE concurred with the summary of our findings in an email
correspondence dated October 22, 2008.
There are no additional impacts anticipated for this project.
2. Stream Restoration Plan (sediment impacts) -Sediment impacts to the stream must be
removed. Asa part of this plan, you should provide the amount (depth) of material
that has been deposited in the stream. This information should be depicted on a map
you provide. It is recommended that you use hand labor (buckets, shovels and
wheelbarrows) to remove deposited sediment from the stream. The sediment should
be removed from the stream and taken to high ground and stabilized. Also, the plan
must address the measures that will be used for temporary stabilization/sediment
control while this work is under way.
S&EC has been engaged by Panther Rock, LLC to provide the NC DWQ and the
USACE with a Stream Stabilization and Repair Plan for the streams associated with
Impact Nos. 1 and 2. This will include a stream restoration plan, removal of the rip-
rap and in stream sediment and stream bank stabilization. Additionally, S&EC will
be removing the minor rip-rap amounts that have been tossed and/or have fallen into
the stream channel (by hand) and will be suggesting additional stream bank
stabilization measures on both the upstream and downstream ends of Impact No. 3
(road crossing).
The Stream Stabilization and Repair Plan is currently being developed and will be
submitted to both the USACE and the NC DWQ for approval under separate cover
within the next 60 days. The Stream Stabilization and Repair Plan will include a
detailed implementation schedule and the necessary 3-year monitoring plan for the
repaired stream channels.
3. Please explain in your response when and how you anticipate achieving compliance
with the 401 Water Quality Certification.
As discussed previously, S&EC has been engaged by Panther Rock, LLC to develop
a Stream Stabilization and Repair Plan for the stream channel impacts noted during
the October 21, 2008 site visit. We anticipate having this Plan submitted to both the
USACE and the NC DWQ for approval under separate cover within the next 60 days.

This plan will have a detailed implementation and construction schedule for
completion.
4. A rain gauge must be properly installed as required by the Construction Stormwater
(NCG010000) permit. Provide a statement documenting the location of the rain
gauge.
The site NPDES monitoring box and rain gauge are located just to the right of the
traffic circle on the berm of sediment basin No. 4. All copies of the monitoring
reports and the approved Erosion and Sedimentation Control Plan are within the box.
5. Provide all rain gauge data collected to include the past four months of monitoring
through the date of your written response to this letter. If you do not have this date,
explain why.

COMMENTS: Sewer outfall is being cleared. Sediment transport potential is high with land disturbance in the
stream channel. A bypass channel has been installed at the stream crossing below the end of construction at
back of project. Suggest laying slopes back on by pass channel, installing silt fence on channel edge and
armoring area. A stockpile of wood mulch is adjacent to area and should be used to stabilize the area and

COMMENTS: Clearing has started on the lots south of Streets B and D and the Recreation site. Diversion
berms to basins # 5 and #6 have been altered to capture drainage from the lots behind streets B and D. Almost
no drainage now goes to SB # 5 with most of that area now graded so drainage goes to SB # 6. The storage
area in these basins is being reduced as the lots are filled. Make sure the basins are not completely filled until
the lots above this area are stabilized with vegetation. Silt fence has been installed around the perimeter of the
recreation site. Suggest a small sediment trap at the low point of that area. Drainage and steep slope may be too
much for silt fence alone to handle. Road shoulders need seeding in areas where paving and utilities are in
place. Watch the area at the stream crossing and reinstall diversion ditches before each rain event, as
construction traffic across this area will form a conduit for storm water/sediment drainage down the roadway.
Potential issues with Stub Street C at lot #1. Road C (south of traffic circle) is paved now. Suggest a rip rap
berm at the end to this stub street to slow runoff to a non erosive velocity where pavement ends.

this area. Concrete trucks have washed out at this point and filtered outlet structure is concreted in place.
Concrete washout should be in a designated area away from any drainage as this is washing to the stream
below. This is a violation of the NPDES requirements and should cease immediately. Suggest a rip rap filter
berm be installed at the end to this stub street to slow runoff to a non erosive velocity where pavement ends.
Suggest installing a designated concrete washout area (contained in silt fence on 3 sides.

COMMENTS: The entire site has been seeded and mulched. The skimmer in Riser basin # 7 is being held
down with accumulated sediment deposition in the basin. Suggest removing the sediment over the pvc drain
pipe the next time the basin is dry. Issues the with Stub Street C at lot #1. Road C (south of traffic circle) is
paved now. The silt fence and filtered outlet structure have filled and sediment has washed into the wooded
area below this area. Concrete trucks have washed out at this point and filtered outlet structure is concreted in
place. Concrete washout should be in a designated area away from any drainage as this is washing to the
stream below. This is a violation of the NPDES requirements and should cease immediately. Suggest a rip rap
filter berm be installed at the end to this stub street to slow runoff to a non erosive velocity where pavement
ends. Suggest installing a designated concrete washout area (contained in silt fence on 3 sides.

maintenance. The slope above this area is starting to erode. This area is just above a stream so it needs to be
addressed as soon as possible. The area at the end of pavement at stub Street C at lot #1 is starting to scour
out and the silt fence and filtered outlet at the edge of disturbance needs repair. This will be a continuous
problem as the storm water velocity off the paved street is too high. Suggest a lined rip rap filter berm be

COMMENTS: The silt fence at the toe of slope sat the proposed recreation center location is in need of
maintenance. The slope above this area is starting to erode. This area is just above a stream so it needs to be
addressed as soon as possible. The area at the end of pavement at stub Street C at lot #1 is starting to scour out
and the silt fence and filtered outlet at the edge of disturbance needs repair. This will be a continuous problem
as the storm water velocity off the paved street is too high. Suggest a lined rip rap filter berm be installed at
the end to this stub street to slow runoff to a non erosive velocity where pavement ends. Suggest installing a
designated concrete washout area (contained in silt fence on 3 sides) in a relatively flat area out of any
concentrated storm water flow. The spillway tarps on multiple basins are starting to deteriorate and need repair

COMMENTS: The slope drains at the rec center are protecting the slope from erosion but sediment is being
flushed down the pipes from lot erosion above. Suggest scour holes and a horseshoe filter berm at entrance of
pipes. Make sure these are lower than berm at top of slope. The silt fence at the toe of slope need sediment
removed as the sediment that flushed down the slope drains is filling the silt fence. (These slope drains
prevented massive slope failure during this heavy rain event and even with the minor sediment were a huge
benefit to preventing sediment discharge into the stream below. Suggest angling the slope drains at the bottom
of the slope to slow the water velocity exiting the smooth pipe to a non erosive velocity. Basin # 6 is staring to
have the spillway berm undermine from a small hole in the tarp. Multiple spillway tarps had been temporarily
repaired weeks ago with tape over the small rips in the tarps. This repair will be short lived as the tarps are
aging out and will continue to deteriorate. Basin # 3 has huge rips now and will need replacing (it was repaired
with tape several weeks ago). Highly recommend that "Dura Skrim " be used as the liner instead of the silver
tarps as it will last twice as long as the silver tarps.

COMMENTS: The Silt fence south of road D has been repaired. The fill slope above this is eroding and the
ditch is starting to fill with sediment. Suggest reseeding the fill slope. The slope drains at the rec center are
protecting the slope from erosion but sediment is being flushed down the pipes from lot erosion above. Suggest
scour holes and a horseshoe filter berm at entrance of slope drain pipes. Make sure these are lower than berm
at top of slope. The silt fence at the toe of slope need sediment removed as the sediment that flushed down the
slope drains is filling the silt fence. (These slope drains prevented massive slope failure during this heavy rain
event and even with the minor sediment were a huge benefit to preventing sediment discharge into the stream
below. Suggest angling the slope drains at the bottom of the slope to slow the water velocity exiting the smooth
pipe to a non erosive velocity. Basin # 6 is staring to have the spillway berm undermine from a small hole in the
tarp. Multiple spillway tarps had been temporarily repaired weeks ago with tape over the small rips in the tarps.
Several of these tarps now have additional rips. The tarps are aging out and will continue to deteriorate. Basin #
3 has huge rips now and will need replacing (it was repaired with tape several weeks ago). Highly recommend
that "Dura Skrim " be used as the liner instead of the silver tarps as it will last twice as long as the silver tarps.
