In addition, further discussions between S&EC, Crescent Resources, the US Army Corps of Engineers and yourself has led to S&EC preparing this NOV response. Within the October 22, 2008 NOV, the following violations were listed and identified: 1) 401 Water Quality Certification Condition Violation 2) Removal of Best Usage 3) Other Waste (In-stream sediment) 4) Stormwater General Permit - NCGO10000 Violation The remainder of this letter will respond to each item individually; the original request will be in italics followed by our response: 1. Documentation depicting all jurisdictional features (e.g. steams and wetlands). A description and quantification of the impacts to those jurisdictional features and your plans to avoid further stream and wetland area impacts on the site. On February 1, 2005, Mr. Todd Tugwell, formerly with the USACE, issued a Notice of Jurisdictional Determination (JD) for the jurisdictional streams and wetlands for The Retreat on The Haw River Soil & Environmental Consultants, PA November 26, 2008 Project No. 6748.P1 the entire subject property (see Action ID 200421124). This JD does not expire until February 1, 2010. The original permit requests in 2004 and subsequent approvals called for 109 linear feet of permanent impact to unimportant/intermittent stream channels and 194 liner feet of permanent impact to important/perennial stream channels. These impact details were quantified and illustrated in the initial permit submittal. Field observations made by S&EC staff on September 23, 2008 are as follows: Impact No. 1: Permitted in 2005: 74 linear feet of permanent intermittent/unimportant channel impact for road crossing (30" RCP) and 35 linear feet for rip rap pad (total 109 linear feet of permanent intermittent/unimportant channel impact); Observed in September 2008: 74 linear feet of permanent intermittent/unimportant channel impact for road crossing (30" RCP) and 23 linear feet for rip rap pad (total 97 linear feet of permanent intermittent/unimportant channel impact); additional temporary impact (not permitted) includes a check dam upstream of the crossing and a collection of large rocks in the channel. Impact No. 2: Permitted in 2005: 60 linear feet of permanent perennial/important channel impact for road crossing (60" RCP) and 40 linear feet for rip rap pad (total 100 linear feet of permanent perennial/important channel impact); Observed in September 2008: 40 linear feet of permanent perennial/important channel impact for road crossing (60" RCP) and 56 linear feet of rip rap pad (total 96 linear feet of permanent perennial/important channel impact); additional temporary impacts include approximately 6 linear feet of non-native rock immediately upstream of the crossing as well as two pre-existing, failing corrugated black pipes. Impact No. 3: Permitted in 2005: No charnel impacts as a bottomless arch was proposed; Observed in September 2008: No channel impacts were observed as the bottomless arch was installed per the 2005 Approvals. Impact No. 4: Permitted in 2005: 94 linear feet of permanent perennial/important stream channel impact for road crossing; Observed in September 2008: No channel impacts were observed as a bridge was built for this crossing instead of traditional culverts. There are no additional impacts anticipated for this project. 2. Stream Restoration Plan-Please explain how you plan to restore the pattern, profile and dimension of the impacted stream channels to include the removal of the boulders from the stream, removal of the check dam and stabilization of the banks. The streambed must be restored to the original profile and the stream banks must be stabilized. Page 2 of 4 The Retreat on The Haw River Soil & Environmental Consultants, PA November 26, 2008 Project No. 6748.P 1 S&EC has been engaged by Crescent Resources to provide the NC DWQ and the USACE with a Stream Restoration plan for the streams associated with Impact Nos. and 2. This will include a stream restoration plan, removal of the check dam and stream bank stabilization. It should be noted that during the October 2, 2008 site visit, both the USACE and the NC DWQ were in agreement that the check dam located upstream at Impact No. 1 should remain in place until the sediment basins are removed. It is not anticipated that these temporary sediment basins will be removed from the project for at least another year. The Stream Restoration and Stabilization plan is currently being developed and will be submitted to both the USACE and the NC DWQ for approval under separate cover within the next 60 days. The Stream Restoration and Stabilization plan will include a detailed implementation schedule and the necessary 3-year monitoring plan for the restored stream channels. 3. Stream Clean Up Report (sediment impacts) - Sediment impacts to the stream must be removed. It is recommended that you use hand labor (buckets, shovels and wheelbarrows) to remove deposited sediment from the stream channel. The sediment should be removed from the channel, taken to high ground away from the stream channel and stabilized. Provide a report that describes the measures taken to remove sediment deposition and include photos. As discussed previously, S&EC has been engaged by Crescent Resources to develop a Sediment Delineation and Removal report for the stream channels noted during the October 2, 2008 site visit. On October 2, 2008 S&EC delineated the sediment found at the locations noted during the site visit with DWQ and the USAGE, namely Crossing No. 1 and the Williams Pond relic spillway. On October 14, 2008 S&EC Personnel along with Eco Terra Landscape and Erosion Control, Inc completed the sediment clean-up. The Sediment Clean-up Completion report was submitted to the both the USACE and NC DWQ on October 22, 2008. 4. Permit Application - If you wish for any impacts to remain in place, you must contact the U.S. Army Corps of Engineers (USA CE) and the DWQ to modify your 404 and 401 permits. Please note that sediment impacts to streams are not permittable. S&EC has been engaged by Crescent Resources to prepare and submit a Sedimentation Clean-up Plan as well as a Stream Restoration and Bank Stabilization Plan. It is not the intent of the applicant, Crescent Resources, that any of the unauthorized, temporary impacts to remain in place. Please provide a statement documenting that the approved Erosion and Sedimentation Control Plan is on-site and available for review. A rain gauge must be properly installed as required by the permit. Please provide a statement documenting the location of the rain gauge. Provide all rain gauge data collected to include the past three months of monitoring through to the date of your written response to this letter. If you do not have data, explain why. Explain the steps taken to ensure future compliance with the Twenty-four Hour Reporting requirement. The Erosion and Sedimentation Control Plans are on-site at the Phase One construction entrance on Bynum Ridge Road and are available for review. There is also a rain gauge located on the entrance gate post on the left side. We have attached the monitoring reports from the past month provided by Mr. Fred Ward of the Chatham Land Management group. Past monitoring and reporting was done by Glover Construction Company, Inc. who supplied the reports and data to Crescent Resources (see attached letter). At this time, Crescent Resources is unable to locate those reports. Mr. Fred Ward of the Chatham Land Management group has been retained by Crescent Resources to provide Erosion and Sedimentation Control monitoring and reporting for The Retreat on the Haw River development site to ensure compliance with all aspects of the approved Erosion and Sedimentation Control Plan. Tryon Street Suite 1300 Charlotte, NC 28285 Re: Retreat at Haw River To Whom It May Concern: Glover Construction Co., Inc. had our Superintendent (Eddie Miller) prepare (at a minimum) the weekly monitoring records required to meet the NPDES Stormwater Discharge Permit for Construction Activities (General Permit NCG010000) requirements which were part of the Chatham County Soil Erosion and Sedimentation Control approval obtained for the project. The inspections were conducted beginning approximately January 26, 2007 and ending approximately February 22, 2008. These reports were retained on site during construction as required by the permit and provided to a Crescent representative upon demobilizing from the site.
