Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: Existing conditions consist of a maintained 40' wide Town of Apex Combined Utility & Greenway Easement with existing sanitary sewer and waterline. The White Oak Creek floodplains along with riparian wetlands are within the project area. The termini of the project is Oak Haven Lane, between lots 230 & 231 and the Cedar Hedge Court cul-de- sac. The general land use in the vicinity of the project is residential. 3b. Describe the overall project in detail, including the type of equipment to be used: The overall project consists of the construction of a connector greenway from Oak Haven Lane, between lots 230 & 231 and the Cedar Hedge Court cul-de-sac. Specifically the greenway will utilize a boardwalk over White Oak Creek and three (3) at grade wetland crossings. This greenway section was previously authorized as a part of the Beckwith Property project. Equipment typically used for construction and earthwork such as backhoes, bulldozers, excavators, graders, pavers etc. will be utilized for this project. 4. Jurisdictional Determinations 4a. Comments: A No Practical Alternatives Review will be completed by the Town of Apex Page 7of12 D. Impact Justification and Mitigation 1. Avoidance and Minimization 1 a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. S&EC completed a wetland delineation and Jordan Lake Watershed Buffer evaluation for the proposed greenway corridor in order to identify natural resources so that impacts could be avoided & minimized to the maximum extent practicable. The Greenway connection will be approximately 1,100 linear feet long and has been designed to be constructed primarily within the existing Town of Apex 40' Combined Utility and Greenway Easement. The greenway will include a 145 linear foot boardwalk to avoid stream impacts, and the remaining will be an at grade 10' asphalt trail. The 40' Combined Utility and Greenway Easement includes a sanity sewer and waterline previously permitted and installed by the developer. Utilizing the existing utility easement where a sanitary sewer was previously constructed allows the greenway to be built within a maintained corridor which provides overall minimization of proposed wetland impacts. For the boardwalk section, an additional variable width greenway trail easement has been added to provide a minimum separation distance from the sanitary sewer and waterline, and the boardwalk section. This was to avoid the boardwalk pilings that are driven into the ground to be near the below ground surface sanitary sewer. Furthermore, the applicant is aware of the regional conditions associated with the Nationwide Permits 14. With respect to Linear transportation projects and Nationwide Permit 14 (NWP 14 -Regional Conditions section 4.0) the applicant is not proposing stream relocations or impacts within tidal waters/wetlands; the crossings are only upland to upland and are not being utilized in combination with a NWP 18 creating uplands; the proposed temporary crossings are not within a trout watershed. 1 b. We have reviewed the "DRAFT Internal Policy, Cumulative impacts and the 401 Water Quality Certification and Isolated Wetland Programs" document prepared by the NC Division of Water Quality on April 10, 2004, version 2.1. The White Oak Creek Greenway Connection project does not specifically meet any of the three criteria of private or publically funded projects that can clearly result in cumulative impacts; this project should not result in additional residential or commercial development and/or have growth -stimulating effects, this greenway is being constructed in an already developed landscape. Additionally, the project is located within the Town of Apex's jurisdiction, therefore any adjacent properties that have potential for development will have the following regulations to protect downstream waters: 1) the Phase 11 NPDES Stormwater Permit Program, this program includes permitting requirements for Municipal Separate Storm Sewer Systems (MS4s) in addition to post -construction stormwater management requirements; 2) Jordan Lake Watershed Riparian Buffer Protection regulations, these regulations require limited development within the riparian buffer area in addition to "diffuse flow" requirements at a minimum and could require Best Management Practices that control nitrogen if diffuse flow cannot be achieved; and 3) the Water Supply, Watershed Protection Program which limits development densities as well as requires protective riparian buffers. We anticipate that the NCDWR will advise us if any additional information is needed. 4. Sewage Disposal (DWQ Requirement) 4a. Clearly detail the ultimate treatment methods and disposition (non -discharge or discharge) of wastewater generated from the proposed project, or available capacity of the subject facility. Install approved time protection fencing, signs, and/or any other protection measures that may he required. Call Planning at 249-3426 for a final inspection of protection measures.
