Thanks for the update, Patty. Best of luck with the impending weather.
As I told Nikki yesterday, in light of the repetitive issues on this site, the Corps is sending
a permit non-compliance letter. It should go out today (to NCDOT Div. 7 and the
contractor) and will reference the project history, specific permit conditions in violation,
and the steps forward.
I also understand that a follow-up site visit is planned, which I plan to attend.
Please let me know if you have any questions in the meantime.

Dave and April:
I wanted to follow up as to the on-going revisions and work on this project to let you
know what has been done and what remains to be completed. The Contractor is
working to install the recommended devices and has made some headway. However,

not all are complete as you can see from the attached list, most notably is the up sized
pipe installation. Acquisition of the pipe is underway but is not on site at this time. The
rainfall that is predicted and is now occurring could cause additional issues at this site.
We are working with the Contractor to get all devices corrected and in place as soon as
possible and will continue to do so but the current storms unfortunately may not allow
this to proceed as we need to. From the previous email, your intention was to review
the site tomorrow and if necessary, a NOD would be issued. We just wanted to keep
you informed as to the status of the work and ask your consideration of the current
storm and rainfall that is occurring and is predicted to continue.
