Box 338 Fair Bluff NC 28439 Subject Property: 1012 Causey Road REQUEST FOR MORE INFORMATION Dear Mr. Horne: On September 26, 2008, the Division of Water Quality (DWQ) received your After-The-Fact Pre-Construction Notification (PCN) application to impact approximately 0.49 acres of 404 Wetlands and 20 linear feet of stream to provide access to an existing residence. Additional information was received by the DWQ on October 16, 2008. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H.0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. Part VI of the PCN indicates that you wish to apply for 0.49 acres of wetland impacts. The DWQ has determined that the actual impacts on site are 1.834 acres. Revise the PCN to reflect the actual impacts to jurisdictional waters. For impacts of this amount, you must submit an application for an Individual Permit along with the appropriate fee. 2. Submit a mitigation plan as required by 15A NCAC 2H .0500. The plan must be appropriate to the type of impacts proposed. 3. Locate any planned or existing sewer lines on the site plan and re-submit your site plans on full plan sheets at a scale of no smaller than 1 "=50'. 4. Part VI (4) of the PCN states that you will need 20 linear feet of stream impacts yet Part VI (6) lists only 10 linear of impact. Explain this discrepancy. Part VI (3) of the PCN states that the total estimated amount of wetlands on site are 21.2 acres. However, Part VIII of the PCN states that the remaining wetlands on site (+16 acres) will be placed into a conservation easement. Explain this discrepancy. 6. Part VII of the PCN (Impact Justification) has been left blank. Explain why no measures were listed to avoid the proposed impacts. Provide a detailed planting plan for the areas to have fill removed and to be restored (standard format includes: scientific name, common name, source of the plant material, plant spacing, wetland indicator status, etc., as well as planting specifications). 8. Provide stream determination documentation on the site (upstream and downstream photos and DWQ stream identification forms). Respond in writing within 30 calendar days of the date of this letter by sending a copy of this information to me and to Ian McMillan, 401 Wetlands Unit, 2321 Crabtree Blvd, Raleigh, NC 27604-2260. If you will not be able to provide the requested information within that timeframe, please provide written confirmation that you intend to provide the requested information, and include a specific timetable delineating when the requested materials will be provided. If we do not hear from you in 30 calendar days, we will assume that you no longer want to pursue this project and we will consider the project as returned. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
