Dear Mr. Williams and Ms. Homewood,
As per our recent conversations I am providing you with both prior and current wetland permit
related information for Piedmont Crossing project. The purpose for providing the information is
to accurately document past impacts as they pertain to current requests/permit modifications. I
have printed certain pages from our 2005 pre-construction notification approved as Action ID
200420295 and DWQ#05-1881. I will email copies of those to you. Under that NW 39 permit
impacts S-1, S-2, W-1, W-2, W-3, W-4, W-5, T-1, T-2 and 3 separate Isolated wetland pockets
(IW1-3) were approved. In addition an arch span resulting in no stream impact had been
proposed along Piedmont Crossing Drive.

Total impact to mitigable streams was 1491f and .09 acres of wetlands in the 2005 approval.
That particular permit expired in March 2007 with work that was under contract allowed to be
completed prior to March 2008.
On March 10, 2008 S&EC submitted a second pre-construction application related to proposed
impacts associated with development of Piedmont Crossing. In that submittal, impacts S-1, S-2,
W-1, W-2, W-3, W-4, W-5 and T7.1 were shown as already constructed. Upon field review and
updated information/site plans from the project engineer we determined differences in actual
impact versus those requested, namely: S-1 was 881f (due to riprap overage), S-2 was 671f based
on revised plans and sewer impact T-2 was never installed. Within the March 2008
preconstruction notification T-2 was relocated in an effort to lessen Zone 2 impacts to the
Randleman Lake riparian buffer. Instead of 151f of stream impact as per the 2005 submittal, the

relocated sewer crossing involved 201f of stream crossing and 1,352sf of wetland impact.
Additionally the applicant now requested a culvert impacting 1421f of mitigable stream for a road
crossing instead of the 2005 PCN submittal indicating an arch span (no impact).

Since the March 2008 PCN submittal there has been site plan and subsequent impact changes for
the project. On July 9 we received a 401 approval based on the March 2008 submittal. That
same submittal was determined incomplete a few days later in a July 21 notification from the US
Army Corps of Engineers. Based on that denial, plans were changed to eliminate the 1421f of
stream impact for a road crossing (S-3) and resort back to an arch span. The Corps later issued a
Nationwide Permit 29 on September 29. The DWQ however considered the arch span an impact
leading to the latest plans that involve a bridge where impact S-3 had originally been planned.
Considering a total impact to mitigable streams of 1551f (S-1 + S-2) S&EC submitted a plan for
stream bank stabilization at impact S-1 so as to avoid compensatory mitigation. Those plans were
submitted to the USACE for acceptance. Upon completion of the stabilization measures before
and after pictures of the work were submitted to the USACE and NC DWQ. In summary, only
impacts T-2 and T-3 have not already been approved by both agencies and constructed. Based on
work performed at S-1 we are of the opinion compensatory mitigation will not be required.
Furthermore based on recent dialogue with the NC DWQ the proposed bridge at location S-3 is
acceptable with no impact to Waters. Below is a comparison of initial impact approvals and
subsequent requests for the project.
