We also request written concurrence from the NC Division of Water Quality (NC-DWQ) that the project complies with the 401 Water Quality Certification associated with Nationwide Permits 12 & 39. A Pre-construction Notification Application (PCN) is attached, which includes an agent authorization form. S&EC delineated the wetlands and jurisdictional waters present on the subject site in summer 1998. Data forms completed for the wetland delineation are also attached. Please refer to the attached map (Figure 1) for the project's location on a USGS topographic quadrangle. The property comprises approximately 96.3 acres, 4.1 acres of which are jurisdictional wetlands. It is important to note that the site straddles the divide between the Cape Fear and Neuse River basins, and wetland and jurisdictional waters of the U. S. impacts are only proposed for the portion of the site in the Cape Fear River basin (south of Collens Rd.). There is a pond in the northeastern area of the property that is indicated on both the USGS and Wake County Soil Survey maps. Although this pond is in the Neuse River basin, S&EC does not believe that it is subject to the buffers since there is no stream coming from it, and thus, the pond was created in high ground. A determination by the NC-DWQ will be required, and will be scheduled as soon as possible. Approximately 460.5 linear ft. of stream channel and 0.11 acres of jurisdictional wetlands will be impacted for proposed road crossings (impacts R1-R6) under Nationwide Permit 39. Of the impacted stream channel, only 97.5 linear ft. are believed to be significant/important by S&EC (impact R4, refer to attached impact map). Additionally, 97.5 linear ft. of channel and 0.11 acres of jurisdictional wetlands will be impacted for proposed lot fills (impacts 01-02) under NWP 39, totaling 558 linear ft. of stream channel (97.5 linear ft. of significant/important channel) and 0.22 acres of jurisdictional wetland impacts under NWP 39. Three proposed sewer line crossings (impacts S1-S3) will temporarily impact 45 linear ft. of stream channel and 0.03 acres of jurisdictional wetlands under NWP 12. The USACE's current policy requires applicants to avoid and minimize wetland and stream channel impacts to the maximum extent practicable and compensatory mitigation to offset unavoidable losses of waters of the US when impacts exceed the requirements for notification (0.10 acre). The applicant requested a delineation of wetlands present on the property prior to site plan development in order to avoid jurisdictional wetlands to the maximum extent practicable. According to the engineer, it was necessary to impact the channel and jurisdictional wetlands on the east side of the property for road construction and lot fill purposes. These impacts, along with others, are explained in the attached letter from Hugh I Gilleece & Associates, which outlines why proposed impacts are necessary, along with the measures taken to avoid wetlands and waters of the U. S. The remaining 3.85 acres of jurisdictional wetlands and waters of the U. S. of higher water quality not impacted by the project will be preserved onsite. It is also important to note that according to the engineer, the proposed subdivision will result in only 26% impervious cover. NC-DWQ's current policy does not require mitigation for wetland and stream channel impacts below 1 acre and 150 linear feet of significant channel. Because the proposed cumulative impacts resulting from the project do not exceed the aforementioned thresholds (0.25 acres/97.5 linear ft. of significant channel), S&EC believes that wetland or stream channel mitigation should not be required. However, if it is decided that compensatory mitigation is required by the NC-DWQ, the applicant proposes payment to the NC Wetlands Restoration Program (WRP). Channel impacts as a result of the roadway crossings were necessary in order to provide road access throughout the site. All other wetlands areas on the property were avoided and will be preserved. 15. The first item to explain is the fact that this is s five (5) phase mixed use development of 100 ac's. The owner has tried to minimize the areas that are impacted and still meet the requirements of the Town of Cary. The Town of Cary's Planning Department and Fire Department have been trying to maintain more interconnectively in their road system. Cary's early growth had an enormous amount of cul-de-sac; that is now impacting their fire and police coverage, sanitation pick-up and other parts of providing town service. With those thoughts in mind, I will try to explain the impacted areas you questions. Figure 1 - We have broken up the road impacted and the site impacts taken into account the slopes of the site. Given the limits of the 20' property buffers, shape of the property and the fact their needs to be two ways in and out of this area the road need to cross the creek twice. While their seems like a lot of impacted area, this and Figure 2 are the only area we are requesting impacts other than roads and sewer on the site. Figure 2 - There are slopes and a draw the wetlands follows. Moving the road to the north would put the road on more of a channel impact, but the slopes would still impact the wetland area. Keeping the road where it is reduces the total impact on the channel. This is also an area the Town made the developer extend a through street. Figure 3 - Mathew Meadow Lane is a required connection to Jenks Carpenter Road by the Town of Cary Fire Department. Also, this road is located on two property lines and the road runs between two existing houses. It also destroys an existing barn. The road could not be moved in either direction without impacting the existing houses.
