In response to your letter dated April 26th, 2001 (see attached copy), Upchurch Farms,
LLC has revised the site plan for the Upchurch Farms subdivision. The only impacts you
questioned were impacts Rl, R2, 01, and 02. Impacts R2, 01, and 02 have been
completely elimi rl - A. Only one impact, "R1-REVISED," is now proposed for the
project where thf se iri:7%cts were previously proposed. This impact was minimized, but
it is necessary to allow dcr.ess to high ground.
By eliminating; impaer P.2, C % and 02, and revising impact R1 to impact RI-REVISED,
194.71inear ft of F -yearn. chp anel impacts and 0.114 acres of jurisdictional wetland
impacts will be,. in.*(na --: from the 558 linear ft. (97.5 linear ft. of significant/important
channel) and 0.2 ;.ores initially applied for under NWP 39. Thus, the revised site plan
now calls for a total of 363.3 linear ft. of stream channel impacts (97.5 linear ft. of which
are significant/important channel impacts) and 0.106 acres of jurisdictional wetland
impacts under NWP 39.
Based on these revisions, S&EC does not believe that mitigation is necessary for this
project because impacts to jurisdictional wetlands and waters of the U.S. are less than 1
acre and less than 150 ft. of significant stream channel per tributary. Therefore, a site
meeting with Dave Penrose of NC-DWQ should not be necessary.

Dear Sirs:
The Divisi Water Quality ha iewed your plans for the discharge of fill material
into 0.25 ear fe f streams and 558 cres of wetlands located at Upchurch Farms, LLC in
!612ke Cou residential development a escribed in your application dated March 12, 2001.
Insufficient evidence is present in our files to conclude that your project must be built as planned in
waters and/or wetlands in accordance with 15A NCAC 2H .0506. Therefore, unless modifications
of the proposal are made as described below, we will have to move toward denial of your 401
Certification as required by 15A NCAC 2H .0507(e) and will place this project on hold as
incomplete until we receive this additional information, we are requesting (by copy of this letter)
that the U.S. Army Corps of Engineers place your project on administrative hold.
Please provide us with information supporting your position that states your project must
be constructed as planned and that you have no practicable alternative to placing fill in these
waters and/or wetlands. Specifically can you realign the road to minimize impacts R1, R2, 01 and
02? Also Mr. Penrose of DWQ will need to make a visit to determine if stream mitigation will be
e-eded. Any documentation such as maps and narrative that you can supply to address
alternative designs for your project may be helpful in our review of your 401 Certification. Also this
project will require compensatory mitigation as described in 15A NCAC 2H .0506(h). Your
mitigation proposal is insufficient because none was proposed.
Please respond within three weeks of the date of this letter by sending a copy of this
information to me and one copy to Steve Mitchell, Raleigh Regional Office at (919) 571-4700 If we
do not hear from you in three weeks, we will assume that you no longer want to pursue this project
and we will consider the project as withdrawn. I can be reached at 919-733-9646 if you have any
