Coastal Area Management Act Permit 43-15 issued March 24, 2015 As you are aware, the North Carolina Department of Transportation (NCDOT) is constructing improvements to US 17 from SR 1330/SR 1439 south of Belgrade to the New Bern Bypass. Permits for this project were issued in 2015, and the project was let to construction on June 16, 2015. During a recent walkthrough with environmental agencies on 8/9/17, 8,811 square of feet of inechanized clearing was observed outside of the permitted area at Sites 19 and 20 on R-2514D (see attached). These impacted areas are depicted on the attached drawings. The NCDOT hereby requests approval of this additional mechanized clearing by modifying the project permits as appropriate. Based on the information supplied by you on August 30, 2017, the impacts associated with this project are located in CU 03020204 of the Neuse River basin and CU 03020106 of the White Oak River basin in the Southern Outer Coastal Plain (SOCP) Eco-Region, and are as follows: Table 1— Additional Impacts {feet / acres Neuse Stream Wetlands Buffer (Sq. This additional impact and associated mitigation needs were not projected by the NCDOT in the 2017 impact data. DMS is currently providing stream, riparian and non-riparian wetland mitigation for the impacts associated with this project located in cataloging unit 03020204 of the Neuse River basin as required by the 404 Individual perinit, 404 Individual permit modification 401 and CAMA Major permits issued in March 2015, September 2016, April and May 2015, respectively, as show in the below table (in mitigation credits) %'Nothing Compares�_. This mitigation acceptance letter replaces the mitigation acceptance letters issued on November 14, 2014, February 25, 2015 and September 15, 2016. DMS commits to implementing additional sufficient compensatory non-riparian wetland mitigation credits to offset the impacts associated with this project as determined by the regulatory agencies using the delivery timeline listed in Section F.3.c.iii of the In-Lieu Fee Instrument dated July 28, 2010. At the request of the NCDOT and USACE, the additional non-riparian wetland mitigation requirements will be debited from the Croatan Mitigation site located in Neuse 03020204. If the above referenced impact amounts are revised, then this mitigation acceptance letter will no longer be valid and a new mitigation acceptance letter will be required from DMS. 8420.
