Dear Mr. Collins:
On August 10, 2017, the Division issued a Notice of Violation (NOV) against Cube Yadkin Generation
LLC — Tuckertown Powerhouse. The NOV was based upon a violation of the reporting requirement by
failing to submit electronic discharge monitoring reports (eDMRs). Subsequent to your receipt of the
NOV, Mark Gross with Cube Yadkin Generation LLC contacted the Division to inform the Division that
Cube Yadkin Generation LLC had submitted eDMRs since 2015. Due to this, your facility has met the
requirement for eDMR submission in permit NC0081949.
Since Cube Yadkin Generation LLC has been submitting electronically for Tuckertown Powerhouse, and
there has been contact with the Division, I have withdrawn the NOV against the Cube Yadkin Generation
LLC — Tuckertown Powerhouse for the cited violation and directed that the record of this violation be
removed from our files.
