Dear Sirs:
On September 25, 2008, the Division of Water Quality (DWQ) received your application dated
September 11, 2008, with additional information received by DWQ on November 5, 2008 to impact
10,464 square feet (ft) of Zone 1 protected riparian buffers and 14,134 square feet of Zone 2 (ft)
protected riparian buffers to construct the proposed canal, boardwalk, trails from the lots and walkway to
the boat docks and fishing platform. The DWQ has determined that your application was incomplete
and/or provided inaccurate information as discussed below. The DWQ will require additional
information in order to process your application to impact protected wetland, streams and/or buffers on
the subject property. Therefore, unless we receive the additional information requested below, we will
have to move toward returning your application as required by 15A NCAC 21-1.0506 and 2B.0259(8) and
will place this project on hold as incomplete until we receive this additional information. Please provide
the following information so that we may continue to review your project.
Additional Information Requested:
1. The fishing platform on the plans does not appear to be necessary. Please eliminate the fishing
platform or provide additional information as to why it is necessary for this project.
2. Please submit a Level Spreader Supplement Form with all the required items for each proposed
level spreader (see http://h20.enr.state.nc.us/sw/bmp forms.htm).
3. Please provide an Operation and Maintenance agreement for the proposed level spreaders. An
example of an O&M agreement can be downloaded from the following website:

Please respond within three weeks of the date of this letter by sending this information to me in writing
and Lauren Witherspoon of the DWQ Raleigh Regional Office. If we do not hear from you within three
weeks, we will assume that you no longer want to pursue this project and we will consider the project as
withdrawn.
