Project Manager 909 Capability Drive, Suite 3100 Raleigh, North Carolina 27606 Dear Mr. Webster: ?o NovP This correspondence confirms my receipt of your fourth year monitoring report on June 6, 2008, and my response regarding the status of available mitigation credits at the Marston Mitigation Bank you are developing located on the north side on NC 41, approximately twelve miles west of Trenton, in Jones County, North Carolina. The purpose of this letter is to confirm the status of mitigation credits available from this Bank. Based on our meeting on November 12, 2008 and upon review of the annual monitoring report for 2007 (Year 4), we have determined that the success criteria have been meet for year 4. Based on the credit release schedule contained in the mitigation banking instrument (MBI) sixty percent (60%) of wetland restoration/enhancement credits could be available after the forth year; if interim success measures are met. By copy of this correspondence, we confirm that you have satisfied the above requirements for year 4 release and a total of 25.2 credits of the wetland restoration/enhancement credits and 3,850 credits of the stream restoration credits constituting 60% of the Bank's total restoration/enhancement and stream credits are now available for sale.
