OIB East Developing, Inc. Page Two 9. PROJECT DESCRIPTION Please refer to the Field Investigation Report (FIR) for OIB East Developing Co., prepared by Debra Wilson and circulated on 8/14/06. CAMA Major permit 484-07 was issued to OIB East Developing Co., authorizing the construction of a 194-lot residential subdivision including but not limited to access roads, utilities and elevated boardwalks. The permittee has begun work on the initial stages of the subdivision and has installed water and sewer lines as well as prepped the site for road construction. The Ocean Isle Beach Land Use Plan classifies the uplands of the project site as Conservation and Urban Transitional. The waters of Shallotte Sound adjacent to the project area are classified "SA-HQW" by the North Carolina Division of Water Quality. The area is designated as a Primary Nursery Area by the North Carolina Division of Marine Fisheries, and is open to the harvesting of shellfish. This particular project (subdivision expansion) does not encroach within the Estuarine Shoreline AEC of Shallotte Sound, however, development is proposed within the 570' Ocean Hazard AEC. The applicant has signed a new Ocean Hazard AEC Notice for the subdivision expansion. PROPOSED PROJECT: The permittee is proposing to expand the existing subdivision by construction 32 additional lots. Development would also include the construction of two roads (4th and 5th Street), 34 individual high-density stormwater infiltration systems, sidewalks and utilities. Beginning along the east side of Charlotte Street, the applicant proposes to construct two asphalt roads (4th and 5th Street), both of which would extend from Charlotte Street, east to Shallotte Boulevard. Both roads would be constructed within a 60' right-of-way and would consist of a 20' paved section with rolled top curbing. Three stormwater infiltration trenches (two trenches along 4th Street and one trench along 5th Street) would be constructed beneath the roads to capture and provide partial treatment of stormwater runoff. Thirty-two additional stormwater infiltration systems would be installed along the front of each of the proposed lots. These systems were proposed to address future development on each of the lots. Water and sewer for the proposed development would be provided by the Town of Ocean Isle Beach and according to the applicant, permits have been obtained for both projects. Utilities would be installed within the right-of-way, with the exception of the sewer lines, which would run within the confines of the paved road surfaces. Sidewalks would also be constructed with the ROW-s of both 4th and 5th Street. The applicant states that they are not proposing to develop the 32- lots as part of this project (with the exception of the stormwater systems). Instead, each individual property owner would be responsible for obtaining CAMA Minor permits for lot construction. Some lots within the expanded subdivision will not require additional authorization from the Division simply because they would be located outside of the Ocean Hazard and Estuarine Shoreline AEC. According to the Division of Water Quality, the applicant has submitted, but has not yet obtained a High-density stormwater permit for the proposed development. The project has, however, been given a working number (SW8081013). Additionally, the applicant has received an approved Sedimentation and Erosion Control Plan from the Division of Land Resources (Bruns-2009-042), issued on 10/31/08. 10. ANTICIPATED IMPACTS: The initial grading of the property, including road construction, utilities and stormwater system installation would result in the disturbance of approximately 4.55 acres of high ground. The proposed roads, sidewalks and allocated BUA for each lot would result in the creation of approximately 121,356 square feet of impervious surface. Of that number, approximately 21,097 square feet would be located within the 570' Ocean Hazard AEC. Each individual lot owner would be required to obtain a CAMA Minor Development Permit from the Town of Ocean Isle Beach, for subsequent development, if located within a CAMA AEC. The modification is to add additional property to the development. The developer proposes to construct roads, and install water, sewer and stormwater control measures to serve 32 existing platting lots on Fourth and Fifth Streets, Ocean Isle Beach. The project is adjacent to existing residential development, and is located between Charlotte Street and Shallotte Boulevard. Approximately 5.44 acres will be disturbed to complete this work. This project is within the Phase II jurisdiction, and as such all runoff for an approximate 3.5" rain event will be directed to infiltration trench systems. The unsuitable relic soils that need to be removed at the locations of the trench systems will be used as fill on other areas of the site. No materials will be hauled off site. The project is not located within 75' of any estuarine shoreline and there is no riparian access from this property. There is no coastal vegetation and no 401 wetland vegetation on the property. A small portion of this property is located in an Ocean Erodible Area of Environmental Concern, as it is within 570' from the Static Vegetation Line where the annual erosion rate is 4.5'.
