Dear Mr. Randolph and Ms. Higgins:
S&ME, Inc. (S&ME) is submitting this application for authorization of impacts to waters of the U.S. in
accordance with Department of the Army Nationwide Permit (NWP) No. 14 (linear transportation projects)
and corresponding North Carolina Water Quality Certification (WQC) 4088 pursuant to the Division of
Water Resources (DWR).
The project will involve construction of two 10 x 8 foot precast concrete box culvert associated with a new
driveway, which will result in the permanent fill of 22 linear feet of jurisdictional perennial stream channel.
The project will also result in 87 linear feet of temporary stream impact as a result of construction
equipment access. An existing bridge will also be removed as part of the project. In support of this
application, please find enclosed the following:

The purpose of the proposed project is a new driveway associated with the property owned by Duke
Energy. The site is located on the southwest side of Mooresville Road just south of the intersection with
Norwood Drive. An existing access driveway and culvert/wood deck bridge are located across Cabarrus
County Tax PINs 46834522520000, 46835405750000 and 46834405380000 (owned by Duke Energy
and/or Colonial Pipeline).
The existing driveway and culvert/wood deck bridge are not wholly contained on Duke Energy's property,
however, Duke Energy through a transfer of ownership of the wood deck bridge from Colonial Pipeline,
maintains responsibility for the condition of the bridge. It was determined that the culvert/wood deck
bridge is currently unsafe. Repairs to the existing wood deck bridge were evaluated, however, there are
significant design or construction issues with restoring the load capacity of the abutments where scouring
has removed most of the supporting soil. In addition, the existing culvert is undersized for the current
stormwater conditions. Therefore, replacing the bridge/culvert was determined to be the best long-term
solution. Duke Energy is proposing to construct a new driveway and associated culvert that is wholly on
their property, and remove the existing unsafe culvert/wood deck bridge and abandon the existing
driveway that services the properties.
The approximate location of the project area is depicted on the Site Vicinity Exhibit (Figure 1), USGS
Topographic Exhibit (Figure 2) and a Cabarrus County Soil Survey and National Wetland Inventory Exhibit
(Figure 3).
Field Observations
On September 9, 2016 Mr. Joey Lawler with S&ME visited the property to assess potential jurisdictional
areas within the project area. Please reference the previously submitted Request for Preliminary
Jurisdiction report, prepared by S&ME, dated September 28, 2016. Within the project area, waters of the
U.S. are limited to an approximately 500 linear foot portion of Emerson Branch (S1 — Relatively Permanent
Water with year-round flow), an approximately 50 linear foot intermittent stream (S2 - Relatively
Permanent Water with seasonal flow) and an approximately 0.19-acre portion of a mixed scrub-
shrub/forested bottomland hardwood wetland that abuts both streams.
Proposed Project Impacts
The construction of a culvert for the driveway will result in permanent fill of 22 linear feet ofjurisdictional
perennial stream channel (S1). The project will also result in 87 linear feet of temporary stream impact as
a result of construction equipment access. The existing culvert/wood deck bridge will also be removed as
part of the project.

S&ME's consideration of potential protected species habitat began with a review of existing records
obtained from federal and state sources. The U.S. Fish & Wildlife Service (USFWS) list of federally-
protected species (updated April 2, 2015) was consulted for a listing of protected species documented
within Cabarrus County, North Carolina. This review identified one plant species and two animal species.
Listed fauna and flora and their federal status are identified in Table 1.

As part of the protected species review, S&ME also reviewed the North Carolina Natural Heritage Program
(NCNHP) Geographic Information Systems (GIS) files of Element Occurrence (EO) and Natural Heritage
Areas available from NC OneMap. This review found no extant EOs of protected species on record within
a one-mile radius of the project area.
S&ME completed a field reconnaissance of the project area on September 9, 2016 and again on May 5,
2017. The project area consists of agricultural land with active livestock. The stream riparian corridor is
limited to the area around the observed wetland. The existing wooden deck bridge (to be removed as
part of the project) was evaluated for potential bat use. The maintained active agricultural land is not the
prefer��ed habitat for the plant species of concern, and the Schweinitz's sunflower plant species was not
observed. The waters to be impacted are unsuitable habitat for Carolina heelsplitter. The evaluated
bridge did not exhibit evidence of bat use.
The project location map (Figure 1), the USGS quadrangle map (Figure 2) and the 2013 aerial photograph
(Figure 3) were reviewed to determine the general land uses within a one-mile radius of the property. The
surrounding land uses include residential, agricultural, woodlands, and an inline pond formed from the
impoundment of S1 is located just upstream and outside of the project Area. Of these surrounding land
uses, the pond is considered potential habitat for migratory bird concentrations.
Based on the level of review and site reconnaissance, the project area was not considered to provide
suitable habitat for protected species with a likelihood of occurring in Cabarrus County.

A copy of this NWP No. 14 application will be provided to the North Carolina State Historic Preservation
Office (SHPO), requesting that they review their records regarding cultural, archaeological, and historical
resources in or near the project area and provide written comments regarding the interests of their
agency. In the event archaeological or paleontological remains are found during the course of project
construction, and in accordance with NWP regional conditions, construction will be halted and USACE,
SHPO, and the Office of State Archaeology will be notified.
Avoidance and Minimization
Impacts have been avoided and minimized to the extent practicable and have been limited to the areas
necessary to meet current design standards and provide the necessary capacity to reduce upstream
flooding risk. To prevent sedimentation of downstream waters, construction will be conducted in the dry.
Temporary erosion and sediment control measures placed in waters will be removed and the original
grade restored upon completion of the project.
Regulatory Considerations
Sediment and erosion control Best Management Practices (BMPs) will be employed in order to comply
with the appropriate turbidity water quality standards. These BMPs shall be consistent with specifications
governing their proper design, installation, operation and maintenance, as outlined in the most recent
version of the "North Carolina Sediment and Erosion Control Planning and Design Manual" and approved
by the local governing authority.
Sediment and erosion control measures are not anticipated to be placed below the ordinary high water
mark. Impacts have been avoided and minimized, and appropriate measures will be taken during
construction to allow flow and circulation patterns of waters of the U.S. to remain unaffected. Excess
material will be removed to a high ground disposal area. The project is located outside of and will
therefore not disturb the Federal Emergency Management Agency (FEMA) designated 100-year
floodplain, and complies with state and local floodplain management requirements.

Based on past conversations with the USACE and DWR and our understanding of agency guidance, we
anticipate that the proposed project will not require compensatory mitigation for the proposed 22 linear
feet of permanent impact to jurisdictional tributaries, due to minimal area affected and as appropriate
avoidance and minimization procedures have been implemented during the design phase of the project.

PROOF ROLLING NOTES:
1. CONTRACTOR SHALL FURNISH AND OPERATE HEAVY PNEUMATIC TIRED COMPACTION
EQUIPMENT FOR COMPACTING THE ROADBED AND TESTING THE ROADBED FOR STABILITY AND
UNIFORMITY OF COMPACTION.
2. PROVIDE EQUIPMENT WITH THE FOLLOWING FEATURES:
(A) FOUR RUBBER TIRED WHEELS MOUNTED ON A RIGID STEEL FRAME;
(B) WHEELS EVENLY SPACED IN ONE LINE ACROSS THE WIDTH OF THE ROLLER AND ARRANGED
SO THAT ALL WHEELS WILL CARRY APPROXIMATELY EQUAL LOADS WHEN OPERATED OVER
AN UNEVEN SURFACE;
(C) MAXIMUM CENTER TO CENTER SPACING BETWEEN ADJACENT WHEELS IS 32 INCHES;
(D) LOAD CAPACITY FROM 48 TO 50 TONS UNLESS OTHERWISE PERMITTED IN WRITING;
(E) COVER OR CONSTRUCT THE LOADED ROLLER TO NOT TRAP WATER THAT WILL ADD WEIGHT
TO THE BALLAST;
(F) OTHER EQUIPMENT OF EQUAL OR BETTER EFFECTIVENESS MAY BE SUBSTITUTED WITH
WRITTEN PERMISSION, AND
(G) TIRE PRESSURES SHALL BE BETWEEN 68 AND 72 PSI UNLESS OTHERWISE PERMITTED IN
WRITING.
3. INFLATE TIRES WITH AIR ONLY; USE NO LIQUID. PROVIDE BALLASTS CONSISTING OF BULK
SAND, BULK STONE, BAGS OF SAND, STONE OR OTHER MATERIALS OF KNOWN UNIT WEIGHT
SUCH THAT THE TOTAL WEIGHT OF THE BALLAST USED CAN BE READILY DETERMINED AT
ALL TIMES. PROVIDE A SUFFICIENT AMOUNT OF BALLAST TO LOAD THE EQUIPMENT TO A
MAXIMUM GROSS WEIGHT OF 50 TONS.
4. USE RUBBER TIRED OR OTHER TYPES OF TRACTIVE EQUIPMENT FOR OPERATION OF THIS
EQUIPMENT ON THE ROADBED.
5. AFTER THE SUBGRADE HAS BEEN COMPLETED WITHIN 0.5 FEET OF FINAL GRADE, COMPACT
AND TEST THE ROADBED WITH ONE COVERAGE WITH A HEAVY PNEUMATIC TIRED ROLLER.
COVERAGE IS CONSIDERED THAT STAGE IN THE ROLLING PROCEDURE WHEN THE ENTIRE
WIDTH OF THE AREA BEING PROOF ROLLED HAS BEEN IN CONTACT WITH THE PNEUMATIC
TIRES OF THE ROLLER. OPERATE THE EQUIPMENT AT A SPEED BETWEEN 225 FT/MIN AND
300 FT/MIN. PERFORM PROOF ROLLING ONLY IN THE PRESENCE OF THE ENGINEER. PROOF
ROLL AREAS AGAIN FOLLOWING THE COMPLETION OF THE NECESSARY CORRECTIONS.
6. PROTECT ALL STRUCTURAL FACILITIES ON THE PROJECT, SUCH AS, BUT NOT LIMITED T0,
BRIDGES, BOX CULVERTS, PIPE CULVERTS AND UTILITIES, FROM DAMAGE BY THE PROOF
ROLLING EQUIPMENT. PROTECTION MAY INCLUDE UNLOADING AND RELOADING OF THE
ROLLER, DETOURING, PROTECTIVE EARTH PADS OR OTHER SUITABLE MEASURE TO AVOID
