please call me (919-733-9646) about the express stormwater approval of the stormwater
plan for this project (letter signed by you on June 15, 2005 SW7050524). we have an
application for a 401 certification for this project (0.45 acres) received here the
same day that the stormwater plan was approved. the problem is that they have
proposed two wet detention ponds and the general 401 certification requires
constructed wetlands (since this is a NSW watershed). I'm sure that whomever on your
staff reviewed the plan either did not know that there would be wetland impacts
and/or did not know of the 401 requirement for constructed wetlands but in any event,
the engineers (Michael Rice with Bob Chiles and Associates) will likely be rather
unhappy that one arm of DWQ approves his stormwater plan while another arm will
require it to be changed. it is possible to issue a conditional 401 and make them
modify the stormwater plan accordingly (in fact that is the only reasonable way out
of this box that i can see) but the applicant/engineer will still likely be unhappy.
