Box 668 Shallotte NC 28459 Subject Property: Lakeside REQUEST FOR MORE INFORMATION Dear Mr. Hobbs: On October 15, 2008, the Division of Water Quality (DWQ) received your Pre-Construction Notification (PCN) application to impact approximately 0.418 acres of 404 Wetlands for construction of a residential subdivision. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your proj ect. Additional Information Requested: 1. Please locate any planned sewer lines on the site plan. 2. Please provide a written narrative explaining how you intend to comply with the Construction Stormwater General Permit NCGO10000 during construction and who will be delegated to inspect the site and maintain required rain gauge and monitoring reports. 3. Please re-submit your site plans on full plan sheets at a scale of no smaller than I"=50' with topographic contours shown. 4. The site plans submitted with the PCN did not include the entire site. Submit site plans for the entire project. 5. Please provide building envelopes (for all lots with wetlands) detail should be given to lots 94, 99, 136, 148, & 179. Provide evidence that all lots are buildable without requiring additional impacts to wetlands or streams as required by General Certification 3705 (GC3705). 7. Please provide an agent authorization letter for the application signature. Deed restrictions or similar mechanisms shall be placed on all retained jurisdictional wetlands and waters per General Certification 3705 (GC3705). These mechanisms shall be put in place at the time of recording of the property or of individual lots whichever is appropriate. Pleas provide a Draft Copy that includes the proposed preservation language that will be recorded to accomplish this. 9. Please indicate all stream impacts including all fill slopes, dissipaters, and bank stabilization on the site plan. 10. Revise the PCN to reflect any stream impacts or revisions/corrections in the amount of impacts to all waters of the U.S. and to waters of the State. 11. Revise Part VI of the PCN to reflect the existence of Isolated Waters on the site. 12. Please provide stream determination documentation on the site (upstream and downstream photos and DWQ stream identification forms). 13. Please provide cross section details showing the provisions for aquatic life passage for each impact area. 14. This Office believes that Wetland Impact #3 can be moved or reconfigured to avoid the impacts at this location entirely. Please revise the plans to avoid the impacts. 15. This Office believes that Wetland Impact #4 can be moved or reconfigured to minimize the impacts at this location. Please revise the plans to minimize the impacts. 16. Provide an explanation as to why Wetland Impact 46 will be bridged but will include impacts to jurisdictional waters. 17. Provide plan and construction details for the proposed boardwalks on the project detailing how impacts to wetlands and streams will be avoided. Please respond in writing within 30 calendar days of the date of this letter by sending a copy of this information to me and to Ian McMillan, 401 Wetlands Unit, 2321 Crabtree Blvd, Raleigh, NC 27604-2260. If you will not be able to provide the requested information within that timeframe, please provide written confirmation that you intend to provide the requested information, and include a specific timetable delineating when the requested materials will be provided. If we do not hear from you in 30 calendar days, we will assume that you no longer want to pursue this project and we will consider the project as returned. 3 Lakeside Brunswick County 2008-1578 This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
