Tryon Street, Suite 1300 Charlotte, NC 28285 Subject Property: Belgate Commercial Center (Stormwater Management Plan) On October 10, 2008, the Division of Water Quality (DWQ) issued a 401 Water Quality Certification to you, (with a revision to condition #5 in the approval issued to you on October 15, 2008), to place fill within or otherwise impact 861 linear feet of an unnamed tributary to Doby Creek for the purpose of constructing the proposed "Belgate Commercial Project" in Mecklenburg County. In order to meet Condition 8 of the 401 Certification for this project, the 401 Oversight/Express Permitting Unit of the Division of Water Quality received a request from Mr. Matt Edwards, PE and Ms. Beverly Rosenbloom, El, both of Kimley-Horn Associates, Inc. regarding the subject project for acceptance into the Express Review Program. This letter advises you that your project will be accepted into the Express Review Program once the following items are received: a. The application fee of $1500.00 made payable to the North Carolina Division of Water Quality [Stormwater management plan with five (5) drainage areas]; b. Three (3) complete and collated copies of the Express Review Stormwater Management Plan Application [http://h2o.enr.state.nc.us/ncwetlands/documents/Exp Rev SWMA.pdf]; c. Three (3) copies of all supporting information pertaining to this project including: i. Design calculation sheets for all proposed BMP(s) sized for both on-site and off- site drainage, if any; ii. BMP Supplement for each proposed BMP including Design Summary and Required Items Check List (available at http://h2o.enr.state.nc.us/su/bmt) forms.htm) along with all required items; iii. A signed and notarized Operation & Maintenance Agreement for each BMP; d. Three copies of full size plans (with detailed construction information) shall include the following: i. Entire site plan with existing and proposed contours and delineated drainage areas to the BMPs; ii. Erosion and sediment control plans; iii. Plan views and cross sectional details of all BMPs and associated structures with elevations; iv. One (1) data CD of full size plans in TIFF Group 4 format (black and white, not grayscale or color). If the plans are too large to store in TIFF format, they can be stored in PDF. Please be advised that all Stormwater BMPs must be designed, at a minimum, to remove 85% TSS, in accordance with the most recent version of the NC Division of Water Quality Stormwater Best Management Practices Manual. In addition, for projects located in a Trout (Tr) or Nutrient Sensitive Watershed (NSW), the Stormwater BMP(s) you choose should be designed to meet at least 30% nutrient removal efficiency. Details of the Express Review Program requirements can be found at: http://h2o.enr.state.nc.us/ncwetiands/express review.htm The meeting held on October 29, 2008 will substitute for the pre-application meeting that is required prior to the submittal of your completed application package. The clock for this project will not start until receipt of the completed application package and required fee. If the drainage areas exceed what is indicated on the Initial Interest Form and/or the services are different, you may be required to remit an additional fee. You have the option of getting your Stormwater Management Plan approved by the City of Charlotte. However, your SMP must meet their current Phase II SMP ordinance, and BMPs must be designed in accordance with the current NC DWQ BMP Manual. Thank you for your attention to this matter.
