KE 008 Corps Permit Number: 200401077 Nov 1 0 7008 Property Location: Emerald Isle, Carteret County, North Carolina 00A-wATEk Permit Holder: The Nassau Corporation WETLANDS AsosTORW"'- At the beginning of 2007, The Nassau Corporation ("Nassau") performed mitigation work on Lots 1 I and 12 in Dolphin Ridge and Lots 39 and 41 in Royall Oaks in Emerald Isle, North Carolina pursuant to the above referenced Corps Permit. This work was performed under the supervision of Spangler Environmental, Inc. ("Spangler"), and in June of 2007, Spangler prepared and submitted the First Annual Wetland Monitoring/As-Built Report (the "Report"). The Report was supplemented by a letter from Spangler dated June 8, 2007, correcting errors Spangler had made in the Report. After reviewing the Report and visiting the site, in correspondence dated October 25, 2007, Mr. Mickey Sugg ("Mr. Sugg") of the Corps of Engineers ("Corps") expressed concern that the elevations in the mitigation areas might not be low enough to establish and retain the wetland hydrology expected in the mitigation areas. In response to Mr. Sugg's concerns, Nassau agreed to do additional excavation at the mitigation sites, and notified Mr. Sugg of this by letter dated November 6, 2007. Although the additional excavation was delayed for various reasons, in a letter dated May 16, 2008, Nassau notified Mr. Sugg that the additional excavation was almost complete. The additional excavation lowered the elevations in the mitigation areas so they were close to those of the adjoining wetlands, and the additional excavation was completed by the beginning of June. After the additional excavation was completed, representatives for Nassau [Mr. Lenny Butta of LMB Enterprises, LLC (landscaper), Mr. Keith Buck of Prestige Land Surveying, Inc. (surveyor), and Mr. Clint Routson of Ward and Smith, P.A. (attorney)], met with Mr. Sugg and inspected each of the mitigation sites. During this inspection, Mr. Sugg recommended various wetlands plants for placement in the mitigation areas to help establish the wetlands and to incorporate the mitigation areas into the adjoining wetland communities. Pursuant to these recommendations, the mitigation areas were planted with Lizard Tail (Saururus cernuus), Rush (Juncaceae), Red Maple (Acer rubrum), Button Bush (Cephalanthus occidentalis), Wax Myrtle (Myrica cerifera), Bald Cypress (Taxodium distichum), and Sweetbay Magnolia (Magnolia virginiana) in June and July of 2008. Exhibit 1 contains photographs showing the status of mitigation areas as of July 6, 2008. As of July 6, 2008, some, but not all of the wetlands plants, had been planted. After the plantings were completed, the monitoring wells were installed in the mitigation areas pursuant to the instructions and procedures detailed in the "Technical Standard for Water-Table Monitoring of Potential Wetland Sites" prepared by the U.S. Army Corps of Engineers dated June 2005. The plantings have been fairly successful and most of the plants are living and doing very well; however, a few of the trees died after being hit by the salt spray from the hurricane that passed through eastern North Carolina in the summer. The trees that did not survive are being replaced. Considering the growth and health of the wetlands plants in the mitigation areas, the establishment and long term viability of the mitigation wetlands looks very good. We see no indication that would indicate any additional excavation will be required in the mitigation areas, and the soils and hydrology look very good. Exhibit 2 contains photographs showing the mitigation areas on August 24, 2008, after the plantings had been completed and the monitoring wells had been installed. As you will see in the photographs, the mitigation areas are doing very well. Exhibit 3 contains copies of the surveys of the lots showing the locations and elevations of the mitigation areas and monitoring wells installed in the mitigation areas. The mitigation areas are designated "Created Wetlands" on the surveys. Monitoring of the monitoring wells to confirm and document the hydrology in the mitigation areas will commence in February of 2009. Exhibit 4 contains copies of the two Declaration of Wetlands Restriction that have been recorded in the office of the Register of Deeds of Carteret County, North Carolina, pursuant to the Permit requirements to ensure the perpetual protection of the wetlands on the lots (subject to the fill authorized by the Permit). Melanie hnr, =,a of eDECLARATION OF WETLANDS RESTRICTION THIS DECLARATION OF WETLANDS RESTRIWION (hereinafter referred to as the "Declaration") made and entered into effective as of the.20 day of October, 2008, by THE NASSAU CORPORATION (hereinafter referred to as "Declarant") and ALL FUTURE PURCHASERS OR OWNERS of Lots 2 and 39 in Royal Oaks as shown on the plat recorded in Map Book 28, Page 229, in the office of the Register of Deeds of Carteret County, and Lots 9, 11, 12, 15, and 98 in Dolphin Ridge as shown on the plat recorded in Map Book 28, Page 228, in the office of the Register of Deeds of Carteret County; WITNESSETH: WHEREAS, in developing Lot 2 in Royall Oaks and Lots 9 and 12 in Dolphin Ridge, The Nassau Corporation has agreed with the State of North Carolina and the Department of the Army Corps of Engineers (pursuant to one or more permits issued by the State of North Carolina and the Corps of Engineers): (i) to restrict and prohibit any future filling of the wetland areas (such wetland areas are shown as "404 Wetlands" and "Created Wetlands" on the surveys and hereinafter individually and collectively are referred to as the "Protected Wetlands") which are shown and delineated on: (a) the wetland survey plat of Lot 2 in Royall Oaks dated May 25, 2007, revised January 11, 2008, and May 27, 2008, verified by the Corps of Engineers on 10/6/08, and attached hereto as Exhibit 1; (b) the wetland survey plat of Lot 39 in Royall Oaks dated February 1, 2007, revised January 10, 2008, and May 27, 2008, verified by the Corps of Engineers on 10/6/08, and attached hereto as Exhibit 2; (c) the wetland survey plat of Lot 9 in Dolphin Ridge dated June 4, 2004, revised December 4, 2007, and May 27, 2008, verified by the Corps of Engineers on 10/6/08, and attached hereto as Exhibit 3; (d) the wetland survey plat of Lot l 1 in Dolphin Ridge dated June 4, 2004, revised July 8, 2004, December 7, 2007, and May 27, 2008, verified by the Corps of Engineers on 10/6/08, and attached hereto as Exhibit 4; (e) the wetland survey plat of Lot 12 in Dolphin Ridge dated June 4, 2004, revised December 5, 2007, and May 27, 2008, verified by the Corps of Engineers on 10/6/08, and attached hereto as Exhibit 5; BUOl PAGE,?S C? t-.J .i (f) the wetland survey plat of Lot 15 in Dolphin Ridge dated June 8, 2004, revised December 3, 2007, and May 27, 2008, verified by the Corps of Engineers on 10/6/08, and attached hereto as Exhibit 6; and/or (g) the wetland survey plat of Lot 98 in Dolphin Ridge dated June 4, 2004, verified by the Corps of Engineers on 10/6/08, and attached hereto as Exhibit 7; (ii) to restrict and prohibit any other activities in the Protected Wetlands that would be detrimental to the continued existence of the Protected Wetlands; and (iii) that the Protected Wetlands shall be left in perpetuity in their natural or mitigated condition. NOW, THEREFORE, Declarant hereby declares: 1. that Lots 2 and 39 in Royall Oaks as shown on the plat recorded in Map Book 28, Page 229, in the office of the Register of Deeds of Carteret County, and Lots 9, 11, 12, 15, and 98 in Dolphin Ridge as shown on the plat recorded in Map Book 28, Page 228, in the office of the Register of Deeds of Carteret County, hereby are subjected to the provisions of this Declaration and such lots shall be held, sold, transferred, conveyed, used, occupied, and mortgaged subject to the covenants and restrictions hereinafter set forth, which are to run with the title to the aforesaid lots and shall be binding on all persons having any right, title or interest in all or any portion of such lots, their respective heirs, legal representatives, successors, successors-in-title, and assigns, and shall inure to the benefit of The Nassau Corporation, the Dolphin Ridge and Royall Oaks Property Owners Association, Inc., the State of North Carolina Division of Water Quality, the United States of America, U.S. Army Corps of Engineers, the Town of Emerald Isle, and each and every owner and occupant of all or any portion thereof. 2. that no person or entity shall: (a) fill, grade, excavate, or perform any other land disturbing activities in the Protected Wetlands; (b) cut, remove, or harm any vegetation (provided, however, this shall not prevent the limited cutting down and removal of dead, damaged, or leaning trees located in the Protected Wetlands that pose a risk to the health and safety of persons or property); (c) allow animal grazing or animal watering or any other agricultural use on the Protected Wetlands; or (d) construct any structures in the Protected Wetlands; provided, however, benign structures, such as pile-supported walkways and piers, may be permissible but only after such benign structures have been reviewed by the U.S. Army Corps of Engineers and written consent has been given by the U.S. Army Corps of Engineers, and additional mitigation work may be performed by The Nassau Corporation in such Created Wetlands to fulfill the mitigation requirements of the permit but only until the U.S. Army Corps of Engineers notifies The Nassau Corporation that the mitigation in such Created Wetlands is successful. 3. that these covenants and restrictions are intended to ensure continued compliance with one or more of the Permit Conditions in the Permit issued by the United States of America, U.S. Army Corps of Engineers, Wilmington District, bearing Permit Number 200401077, and therefore may be enforced by the United States of America and the State of North Carolina. Furthermore, The Nassau Corporation agrees that The Nassau Corporation, the Dolphin Ridge and Royall Oaks Property Owners Association, Inc., the Town of Emerald Isle, and each and every owner and occupant of all or any portion of the aforesaid lots may enforce these covenants and restrictions. 4. that these covenants and restrictions are to run with the land, and shall be binding on The Nassau Corporation and all future owners, tenants, and/or parties claiming under The Nassau Corporation or its successors and assigns. 5. that this Declaration cannot be amended or modified without the express written consent of the U.S. Army Corps of Engineers, Wilmington District. DECLARATION OF WETLANDS RESTRICTION THIS DECLARATION OF WETLANDS RESTRICTION (hereinafter referred to as the "Declaration") made and entered into effective as of the 20 day of October, 2008, by THE NASSAU CORPORATION (hereinafter referred to as "Declarant") and ALL FUTURE PURCHASERS OR OWNERS of Lot 121 in Dolphin Ridge as shown on the plat recorded in Map Book 28, Page 228, in the office of the Register of Deeds of Carteret County, and Lot 113 in Dolphin Ridge as shown on the plat recorded in Map Book 28, Page 228, in the office of the Register of Deeds of Carteret County; WITNESSETH: WHEREAS, in developing Lot 113 in Dolphin Ridge, The Nassau Corporation has agreed with the State of North Carolina and the Department of the Army Corps of Engineers (pursuant to one or more permits issued by the State of North Carolina and the Corps of Engineers): (i) to restrict and prohibit any future filling of the wetland areas (such wetland areas are shown as "404 Wetlands" and "Created Wetlands" on the surveys and hereinafter individually and collectively are referred to as the "Protected Wetlands") which are shown and delineated on: (a) the wetland survey plat of Lot 121 in Dolphin Ridge dated May 21, 2004, revised May 27, 2008, verified by the Corps of Engineers on 10/6/08, and attached hereto as Exhibit l; (b) the wetland survey plat of.Lot 113 in Dolphin Ridge dated May 18, 2004, revised May 28, 2008, verified by the Corps of Engineers on 10/6/08, and attached hereto as Exhibit 2; and/or (ii) to restrict and prohibit any other activities in the Protected Wetlands that would be detrimental to the continued existence of the Protected Wetlands; and (iii) that the Protected Wetlands shall be left in perpetuity in their natural or mitigated condition.
