This correspondence confirms my receipt of your letter of transmittal dated June 5, 2008, and
the associated year 5 monitoring report (2007) for the Alexander Mitigation Bank which is
located off of Lilly Pad Road (NCSR 1419), adjacent to an unnamed tributary to Contentnea
Creek, approximately five miles east of Snow Hill, Greene County, North Carolina. The purpose
of this letter is to provide comments on the monitoring report and to confirm the status of
mitigation credits available from this Bank.
Based upon review of the annual monitoring report for 2007 (Year 5), we have determined
that the success criteria have been meet for year 5. Based on the credit release schedule
contained in the mitigation banking instrument (MBI) and the Site Specific Mitigation Plan an
additional 15% of credits can be released after the fifth year; if performance criterion are met.
By copy of this correspondence, we confirm that you have satisfied the above requirements
for year 5 releases and a total of 14 credits of restoration and 0.23 credits of creation constituting
75% of the Bank's total restoration credits are now available for sale. Additionally, as you are
aware, the remaining 25% of credits will be released if the bank site meets the overall objectives
set forth in the Site Specific Mitigation Plan (total 100%).
To achieve the release of the remaining 25% of credits for the site, we along with DWQ
would like to schedule an on-site visit to evaluate the whole site to determine if the overall
objectives and Success Criteria set forth in the Site Specific Mitigation Plan have been met. It is
desirable to have all the MBRT members present for this site visit before final closeout of the site
is achieved. We will work with you and the MBRT members to schedule a suitable time to
conduct this on-site meeting.
