SUBJECT: Consistency Certification Submission Status for Proposed Impacts to Approximately
4.67 Acres of Wetlands to Facilitate the Construction of a Mixed Use Development,
Carteret County, North Carolina (DCM#20080152)
Dear Mr. Keller:
We received the consistency certification of Keller Environmental on behalf of Nils Ladenburg
("Applicant") on November 7, 2008 for proposed impacts to 4.67 acres of wetlands to facilitate the
construction of a mixed use development on a 226.88 acre project site. The project site is located
West of Harkers Island Road, East of SR 1333 Between Goose Bay Lane and Crows Nest Road, in
Carteret County, North Carolina.
The submission was filed complete as of November 7, 2008. Pursuant to the requirements of
15 CFR 930.60, the purpose of this letter is to inform Keller Environmental, the Applicant, and the
U.S. Army Corps of Engineers (Corps) that the State of North Carolina has initiated commencement
of its Federal consistency review. Please be aware that as we continue to review this submission that
we may develop questions on the proposed project that will require that Keller Environmental respond
through the submission of additional information.
The public review period for this project was initiated on November 13, 2008. The project has been
distributed to State agencies that would have a regulatory interest in the proposed activity for review
and comment. The public review period will close on December 5, 2008. We intend to make a
decision regarding whether the proposed activity would be consistent with the State's coastal program
soon after. Based on the requirements of 15 CFR 930.62, DCM has until May 7, 2009 to either
"concur" or "object" to the consistency certification.
Please note that the Division of Coastal Management does not typically issue a consistency
concurrence decision until the applicant has obtained all other required State permits and/or
permissions. This allows for DCM to review the final project that may have been modified to
incorporate the requirements of the other State agencies. Other required State approvals may include,
but are not limited to, a Section 401 Water Quality Certification, an erosion and sediment control plan,

a stormwater management plan, and an acceptance of any proposed mitigation by the State's
Ecosystem Enhancement Program (EEP). Before DCM makes a final decision on this consistency
determination, all of these approvals, as required, must be obtained. Please forward copies of those
approvals as they are received to DCM. Thank you for your consideration of the North Carolina
