Dear Mr. Shaver:
The North Carolina Deparhnent of Transportation (NCDOT) is proposing to a 0.1-mile new alignment connection
between Dan Owen Drive and SR 1570 (Factory Road), parallel to US 17 in Hampstead. The proposed connectar
includes two 12-foot lanes and 8-foot grass shoulders. The proposed connector from Factory Road to Dan Owen
Drive would provide traffic on Factory Road access to southbound US 17 and westbound NC 210 through a signalized
intersection on Dan Owen Drive.
Please find enclosed the signed preliminary jurisdictional determination (PJD), pre-construction notification
application (PCl�, stormwater management plan and pernut drawings for the above referenced project that were
prepared for NCDOT by Stantec.
Regulatory Approvals
Section 404 Permit: We anticipate that this roadway project will be authorized under Section 404 Nationwide Permit
(NWP) No. 14.
Section 401 Permit: We anticipate 401 General Certification 4088 will apply to this project. NCDOT is requesting
written approval from the North Carolina Department of Environmental Quality, Division of Water Resources.

This project is dependent on the location of existing roadway with little flexibility to completely avoid impacts. However, to minimize the impact of the
Dan Owen Connector, the grade of Dan Owen Drive was raised which will allow the proposed ditches to tie to the existing wetlands to eliminate
excavation of the wetlands. Class IV cross pipes were utilized to minimize the amount of fill needed for the proposed roadway design.

Typical sediment and erosion control measures will be taken on site. Silt fences and temporary sediment basins will be utilized to prevent sediment
from entering wetlands.

Wetland impacts are associated with road widening along Dan
Owen Drive where an existing 30" RCP will be replaced with
extended dual 30" RCPs.
Typical roadway construction equipment will be used including
backhoes, bulldozers, pans, pavers, rollers, sheepsfoot, and
dumptrucks. All appropriate sediment and erosion control
measures will be implemented and monitored throughout
construction.

General Project Narrative: To minimize the impact of the Dan Owens Connector, the grade of the Dan Owen Road was raised as well as the proposed ditches along Y6 will to tie to the existing wetlands to

A. Preliminary Determination
X There are waters, including wetlands, on the above described project area, that may be subject to Section 404 of the
Clean Water Act (CWA)(33 USC § 1344) and/or Section 10 of the Rivers and Harbors Act (RHA) (33 USC § 403). The
waters, including wetlands, have been delineated, and the delineation has been verified by the Corps to be sufficiently
accurate and reliable. Therefore this preliminary jurisdiction determination may be used in the permit evaluation process,
including determining compensatory mitigation. For purposes of computation of impacts, compensatory mitigation
requirements, and other resource protection measures, a permit decision made on the basis of a preliminary JD will treat all
waters and wetlands that would be affected in any way by the permitted activity on the site as if they are jurisdictional
waters of the U.S. This preliminary determination is not an appealable action under the Regulatory Program
Administrative Appeal Process (Reference 33 CFR Part 331). However, you may request an approved JD, which is an
appealable action, by contacting the Corps district for further instruction. See attached PJD map.
_ There are wetlands on the above described property, that may be subject to Section 404 of the Clean Water Act

Project Description: U-5732 encompasses a proposed new alignment connector roadway from Dan Owen
Drive to Factory Road in Pender County, North Carolina. The archaeological Area of Potential Effects
(APE) measures 0.10 mile in length and 150 feet in width.
SUMMARY OF CULTURAL RESOURCES REVIEW
Brief description of review activities, results of review, and conclusions:
Permitting and funding information was reviewed for determining the level of archaeological input required by
state and federal laws. Based on the submitted "request for cultural resources review" form, the project is state-
funded with no federal permit interaction. As such, Section 106 of the National Historic Preservation Act will not
apply and the project falls in compliance with state archaeological laws. Next, construction design and other data
was examined (when applicable) to define the character and extent of potential impacts to the ground surfaces
embracing the project locale. The APE was designed to capture all areas of potential ground disturbing activity.
Once an APE was outlined, a map review and site file search was conducted at the Office of State Archaeology
(OSA) on Monday, February 13, 2017. No previously documented archaeological sites are located in the APE or
directly adjacent. However, numerous prehistoric archaeological sites have been recorded nearby, in similar
environmental contexts as the study area, suggesting a heightened potential for the recovery of artifacts or
cultural deposits within the APE.
Examination of National Register of Historic Places (NRHP), State Study Listed (SL), Locally Designated (LD),
Determined Eligible (DE), and Surveyed Site (SS) properties employing resources available on the NCSHPO website
is important in establishing the location of noteworthy historic occupations related to a perspective construction
impact area. A cross-check of these mapped resources concluded that none of the above properties are situated
within or proximal to the APE. In addition, historic maps of Pender County were appraised to identify former
structure locations, land use patterns, or other confirmation of historic occupation in the project vicinity.
Archaeological/historical reference materials were inspected as well. In general, the cultural background review
established that no previously recorded archaeological sites, NRHP properties, or cemeteries are located within
the APE. Based on cultural-historical factors, the APE is considered to have a moderate potential for the
documentation of archaeological resources.
Further, topographic, geologic, flood boundary, and NRCS soil survey maps were referenced to evaluate
pedeological, geomorphological, hydrological, and other environmental determinants that may have resulted in
past occupation at this location. Aerial and on-ground photographs (NCDOT Spatial Data Viewer) and the Google
Street View rnap application (when amenable) were also examined/utilized for additional assessment of
disturbances, both natural and human induced, which compromise the integrity of archaeological sites.
Environmental/impact factors suggest a heightened potential for archaeological resource recovery.

SUMMARY OF HISTORIC ARCHITECTURE AND LANDSCAPES REVIEW
DESCRIPTIONOFREVIEWACTIVITIES. RESULTS, AND CONCLUSIONS: HPOWeb reviewed on 6 February
2017 and yielded no NR, SL, DE, SS, or LD properties in the Area of Potential EfFects (APE). Pender
County current GIS mapping, aerial photography, and tax information indicated a partly wooded APE
(viewed 6 February 2017) with mostly late-twentieth-century resources. Circa-1930 and -1945 houses to
the east and west of the Lea Drive E�./Factory Road intersection are both unexceptional and altered
examples of their types located beyond likely project impact. Google Maps ��Street View" confirmed the
absence of critical architectural and landscape resources in the APE (viewed 6 February 2017).
No architectural survey is required for the project as currently defined.
WHY THE AVAILABLE INFORMATION PROVIDES A RELIABLE BASIS FOR REASONABLYPREDICTING THAT
THERE ARE NO UNIDENTIFIED SIGNIFICANT HISTORIC ARCHITECTi/RAL OR LANDSCAPE RESOURCES IN
THEPROJECTAREA: APE extends 100 feet from either end of the proposed 0.10-mile project length and
100 feet to either side of the Dan Owen, Factory Road (SR 1570), and proposed connector centerlines to
encompass anticipated construction activities. The comprehensive county architectural survey (1996-7),
as well as later investigations, recorded no properties in the APE. County GIS and other visuals illustrate
the absence of significant architectural and landscape resources in the APE. No National Register-listed
properties are located within the APE.
This project is compliant with North Carolina General Statute 121-12(a). Should the project
require Federal funding, permits, or licenses, please notify NCDOT Historic Architecture
because review under Section 106 of the National Historic Preservation Act then will be
required. Should the project limits or design change, please notify
NCDOT Historic Architecture as additional review may be necessary.
