RETURN OF APPLICATION
Dear Mr. Kelly:
On August 25, 2008, the Division of Water Quality (DWQ) received your application dated
August 19, 2008, to fill or otherwise impact 1,75 linear feet of perennial stream to construct the
proposed residential development at the site. On October 10, 2008, the DWQ received
additional information from you, however, the DWQ has determined that your application
remains incomplete and/or provided inaccurate information as discussed below. The DWQ will
require this additional information in order to process your application to impact protected
wetlands and/or streams on the subject property.
The previous Request for More Information letter on this project sent by the DWQ on September
24, 2008 stated:
"Please provide an inventory of impervious surfaces in each drainage area. The
inventory should include all proposed building footprints, roads, driveways, sidewalks,
gravel-surfaced areas, amenity areas, etc. A Stormwater Management Plan (SMP) must
be provided for any drainage area that exceeds 24 percent imperviousness. Fore each
BMP, please provide a completed BMP Supplement Form with all required items."
The most recent submittal on this project failed to provide the impervious surface inventory and
also failed to provide a Required Items Checklist with all required items for the proposed
Bioretention Area.
For these reasons your permit application is hereby considered returned. Once you have
redesigned your project to address the problems and inadequacies with your application as it was
submitted, you will need to reapply for DWQ approval. This includes submitting a complete
application package with the appropriate fee.
