Bridge No. 790260 on SR I535 (Weaver Road) over Little Creek, Class C, Rowan County, NC,
WBS Project No.: 17BP.9.R.b2
Dear Mr. La.stinger,
This is a request for a Nationwide Peimit 14 for the replacement of Bridge No. 790260 with a
double barrel box culvert (2@ 10'x $' RCBC) on SR 1535 {Weaver Road) over Little Creek (Class
C) in Rowan County, Attached are the pre-construction notification application, vicinity map, soils
map, topographical map, and permit drawings with the project study area called out. Other
attachments include the mztigation acceptance letter from Division of Mitigation Services (DMS),
the stormwater management plan, the culvert survey report, the No Historic Properties Present ar
Affected Form' for Historic Architecture, and the No Archaeological Sites Present or Affected' for
�h�ro�.
T'he project will permaxrently impact 1351inear feet {50'-culvert, 75'-bank stabilization) and
temporarily impact l O linear feet to install bank stabilization. Low streain flow will be isolated
into one barrel, with 1' sills, and the culvert will be buried 1' below the stream bed to ensure
aquatic passage. The high flow barrel will have 1.5' si�ls and floodplain benches constructed at the
inlet and outlet of the cuIvert. The low flow barrel will be bacicfilled with material that is
excavated from the stream or floodplain and may be supplemented with rip rap if needed. The high
flow barrel will be backfilled with native bed material of agpropriate size and may be
supplemented with rip rap to the sill elevation� to expedite the establishment of a natural stream
bed. The culvert site will be dewatered during constxuction in accardat�,ce with NCDOT's Best
Management Practices.

The USFWS lists Sch�veinitz's sun#lower (Helian�hus sehweinttz��) as endangered, the Northern
Long-Eared bat (NLEB-Myvtis septentriorralis) as threatened, and the Georgia aster as a candidate
species for Rowan County. Habitat is present in the project area for 5chweinitz's Sunflower;
however, a Juiy 31, 2414 survey re�ealed no presence of Schweinitz's sunflower. ConsequentIy, it
was determined that Ihe proposed pmject will have `No Effect' on Schweinit�'s Sunflower.
Habitat is present in the project area for the Georgia aster, huwevec na know sur�eys have
occ�rred. Sunflawer Summer roasting habitat does exist i�� the project area for the NLEB.
Anticipated tree clearing impacts for the project are estirnated to be 0.42 acres. A July 31, 2014
survey of the existing bridge revealed no presence afttte NLEB. The project area falls within the
range ofthe NLEB and there is ltkely tree cutting and/ar percussive activities associated with the
project. Consequently, it is determined that the project'May Affect, not Iikeiy ta adversely aifect'
the NLEB. Thus, for tha propased actian, NCDOT has committed to tne conservation rneasure5
listed below:
1. No alkerations of a known hibernaculum's entrance ar interior environment if it irripairs an
essentia2 behaviaral pattern, including sheltering Narthern ]ong-eared bats (Jan�ary E
through Deceraber 31 };
2. No tree removal within a 0.25-mile radius flf a known hibernacula (January 1 through
December 31); and
3. No cutting or destroying a knawn, occupied msternity roast tree, or any other trees �vithin a
150-foat radius frorn ttte 1cno�vn, occupied maternity tree during the period from June 1
through and including Juiy 31.
The fina[ determinatiot� regarding the NLEB bioIagical conclusion wiil be determined by the
USFWS in consultation with the USACE in accordance �vith Standard L,ocal Operating Fracedures
for �ndengered Species Act Compliance for the Northern Long-Eared Bat in North Carolina,
December 20I6.
Bald Eagles are protected under the Migratoty Bird Zreaty Act and the Baid and Golden Eagle
Protection Act. A field survey of the �rroject study area was conducted an January 2l, 2015. Na
species nr nests were observed. T�erefare, this species will not 6e irnpacted because of praject
construction.
