Mr. Lekson:
We received your letter dated October 22, 2008 in which you request additional information regarding the Rutman Creek
Mitigation Project. Below is a response to each of your concerns:
1. Reference the enclosed August 25, 2008, correspondence addressed to Mr. Jeff Furness, PCS Phosphate Company,
regarding the draft document entitled. " Rubnan Creek Watershed Restoration Plan, Hyde County, North Carlina ",
dated July 21, 2008 ... .... To date, we have not received an updated version of the subjectplan incorporation agency
comments, nor was in included with the PCN application.
The revised copy of the above referenced document was mailed to Jeff Furness of PCS Phosphate Company and Cal
Miller of Wetlands Resource Center October 30, 2008. The document is being reviewed by the aforementioned
individuals and will be dispersed to agencies for review as soon as the review process is complete.
2. ..... ...Iam still waiting for a response from Mr. Manning regarding his interpretation ofelimatic conditions during the
period in which he conducted the wetland work. Until such time that 1 receive this information and provide you with
the appropriate documentation, you have nothing definitive to rely on relating to DA jurisdiction on the site. "
