Sullins, Director Division of Water Quality November 7, 2008 CERTIFIED MAIL Return Receipt Requested 7007 1490 0004 4510 0844 Ms. Lydia G Speck C/O Lydia G Ubaldo 3251 Lake Point Dr. Belmont, NC 28012 Dear Ms. Speck: Subject: Notice of Violation and Notice of Recommendation for Enforcement NOV-2008-CV-0020 Catawba Riparian Buffer Rules 3251 Lake Point Dr. Lake Wylie Gaston County, NC Mr. Alan Johnson of this Office conducted a site investigation on October 29, 2008 at the subject property in response to a complaint regarding an alleged violation of the Catawba Riparian Buffer Rules. Based on his observations, this letter is being issued as a Notice of Violation and Recommendation For Enforcement for violation of the Rules (15A NCAC 2B. 0243) pursuant to North Carolina General Statute 143-214.1. While conducting the investigation Mr. Johnson observed that a patio had been constructed within the 50 ft. riparian buffer. Zone 1 consists of the first 30 feet from the project elevation (in this case the 569 foot elevation) extending landward. The rules limit any impacts to Zone 1 without prior approval. Zone 2 is the remaining 20 ft. No permanent/impervious impacts are allowed in Zone 1 or Zone 2 of the buffer. Be advised that the Division of Water Quality (DWQ) requires that approval be obtained prior to conducting land disturbing activities in Zone 1. The patio that was observed is not allowed under the current regulation. The patio must be removed/relocated outside of the buffer. If you have an explanation for the noted violation that you wish to present, please respond in writing within fifteen (15) days following the receipt of this notice. Your explanation will be reviewed and if an enforcement action is still deemed appropriate, your explanation will be forwarded to the Director with the enforcement package for his consideration.
