Box 891 • Southern Pines, N.C. 28388 (910) 695-1043 9 Fax (910) 695-3317 31 October 2008 Mr. Ian McMillan 401 Oversight/Express Review Permitting Unit NC Division of Water Quality 1650 Mail Service Center Raleigh, NC 27699-1650 RE: Savannah's Garden subdivision DWQ Project #08-0680, Moore County Dear Mr. McMillan: This letter is in reference to the after-the-fact permit application for impacts to jurisdictional wetlands at the Savannah's Garden subdivision in Carthage, Moore County, North Carolina and your Request for More Information, dated 9 October 2008. We offer the following information and the enclosed maps (5 copies) in response to your request. Item 1 in your letter indicated concern that the proposed average square footage for future homes on the recently revised site plan (submitted 29 September 2008) was significantly different from that of existing homes within the subdivision. One important reason for the difference was that many 2-story homes were proposed in future construction. More 2-story homes were proposed for 2 reasons. First, DWQ has expressed much concern over previously proposed impervious area and secondly, the 2-story designs are more appealing on several lots whose topography would allow for a walk-out basement. Item 2 in your letter concludes that DWQ considers drainage areas 1, 4, 5 and 7 to be greater than 24% impervious based on the assumption that we incorrectly submitted the proposed area of future homes (Item 1). In order to address both items (in addition to the explanation offered above), Neal Smith Engineering, Inc. (NSE) has revised the site plans again (enclosed). Revisions include removing 5 homes and lots at a significant financial loss and changing proposed home designs to include a wider range of sizes. Specific changes within the drainage areas of concern include the following: Endangered Species Surveys 9 Environmental Assessments • Land Management • Wetlands Mapping and Permitting J ¦ Drainage Area 1. One (1) home and 1 lot were removed, reducing the proposed impervious area by 2.2% (21.5% of the total area). ¦ Drainage Area 4. No changes were made. Due to ongoing construction (lot 19), existing and proposed impervious calculations have changed compared with the September map submission. The total projected impervious area is 23.9%. Most of this calculation is based on actual measurements from existing dwellings, driveways and roads and is therefore indisputable. We propose deed restrictions for the 5 remaining lots (lots 14, 15, 16, 17 and 42) to restrict impervious area to 23% of the lots' respective total areas in order to ensure that this drainage area does not exceed 23.9% impervious. ¦ Drainage Area 5. Road 3 was shortened and 3 houses and lots were removed, reducing the proposed impervious area by 1.2% (22.4% of the total area). ¦ Drainage Area 7. The roads were redesigned to allow some drainage to be directed to a new area and 2 houses and lots were removed, reducing the proposed impervious area by 3.4% (20.5% of the total area). Drainage Area 9 was created. Drainage area 9 removed 109,561 ft2 from the total area of Drainage Area 7 and has a proposed impervious area of 20.2%. In order to ensure that the proposed changes are satisfactory and to alleviate continued delays, we would like to request a meeting with the DWQ staff members who will be involved in the final review of this project. In order to give agency staff time to review this information, we would like to meet approximately 1 week after DWQ's receipt of this package. As a reminder, this project has an approved Wetland and Stream Restoration Plan for which work must be completed by December 1, as directed by your agency and the US Army Corps of Engineers. Restoration cannot begin until the NC Division of Land Resources receives an updated final project design for the Erosion and Sediment Control Plan.
