At Brad's suggestion, we have added an elevated pier over the wetlands for lot 30. I am forwarding the revisions I sent
Brad for your files, In addition to the revised Site Plan, we are also revising the language for the restrictive covenants.

Brad,
Attached is the revised Site Plan (Master Layout Supplement) for Shadow Creek Estates showing the addition of the 6'
wide elevated wooden walkway/pier over wetlands on Lot 30 to reach Howards Creek. Charles Rawls (surveyor) is
revising the wetland maps to be recorded with the restrictive covenants for the subdivision to include this wooden
walkway. I will send a copy of the revised wetland maps to you as soon as 1 receive them from Charles.
Also attached is the revised language for the restrictive covenants to include specifications for the pedestrian footbridges
for lots 42, 43, 46, 47 and the wooden pier for lot 30.
Thanks again for all of your help. Please let me know if anything else is needed.

Shadow Creek Estates Subdivision
Restrictive Covenants
Shadowcreek Estates, LLC will include the following language in the restrictive covenants to be recorded
for Shadow Creek Estates prior to the sale or conveyance of any lots or other property within the
subdivision:
"The areas shown on the recorded plat Wetland Map for Shadow Creek Estates Sheet 1 of 2 and Sheet 2
of 2 dated May 29, 2008 (signed and sealed by Charles A. Rawls, Professional Land Surveyor on October
3, 2008), Swansboro Township, Onslow County, North Carolina as conservation areas shall be
maintained in perpetuity in their natural or mitigated condition. No person or entity shall perform any of
the following activities on such conservation area:
a. Fill, grade, excavate or perform any other land disturbing activities
b. Cut, mow, burn, remove, or harm any vegetation
c. Construct or place any roads, trails, walkways, buildings, mobile homes, signs, utility poles or
towers, or any other permanent or temporary structures
d. Drain or otherwise disrupt or alter the hydrology or drainage ways of the conservation area
e. Dump or store soil, trash, or other waste
f. Graze or water animals, or use for any agricultural or horticultural purpose
For each of lots 42, 43, 46, and 47, a single wooden, slatted, and elevated footbridge is allowed to cross
conservation areas (as shown on recorded wetland maps). The footbridges shall be no wider than four
feet and shall be elevated at least three feet above the wetland substrate as measured from the bottom
of the decking.
For lot 30, a single wooden, slatted, and elevated pier to Howards Creek is allowed to cross conservation
area (as shown on recorded wetland map). The pier shall be no wider than six feet and shall be elevated
at least three feet above the wetland substrate as measured from the bottom of the decking.
This covenant is intended to ensure continued compliance with the mitigation condition of a Clean Water
Act authorization issued by the United States of America, U.S. Army Corps of Engineers, Wilmington
District, Action ID 20081203, and therefore may be enforced by the United States of America. This
covenant is to run with the land, and shall be binding on the Owner, and all parties claiming under it.
The restrictive covenants will also contain a provision that the property owners (either all of them or
some percentage of them) cannot amend or modify the restrictive covenants without the express
consent of the U.S. Army Corps of Engineers, Wilmington District.
