On-Site Intermittent/Perennial Stream Determination
Dear Mr. Keller:
On October 14,2008,at your request Amy Chapman and Periann Russell conducted an on-site determination to
review one stream feature located on the subject property to determine their intermittent/perennial status. The
feature is labeled as"A"on the attached maps initialed by Lia Myott on December 21,2007 and Amy Chapman on
October 17,2008. Lia Myott from the Division of Water Quality(DWQ)401 Oversight/Express Review Permits
Unit had previously conducted an on-site determination of the stream. In your letter to the Director dated September
5,2008,you requested an appeal of her determination.
At your request, Amy Chapman and Periann Russell conducted an appeal of Lia Myott's previous determination as
stated above. During the review Amy Chapman evaluated the stream using the DWQ Stream Classification Form
(form). She evaluated the point at which she believed the stream to begin and calculated the score of that reach to be
21 points from flag"A I"to flag"A2". Further downstream from flag"AY to flag"A4"the feature scored 22 points
and from flag"A5"to flag"A6"the feature scored 26.5 points. The form states that if the score is"greater than or
equal to 19 points the stream is at least intermittent".
The DWQ has determined that the stream labeled as"A"on the attached map is at least"intermittent"and that
feature"A" is an isolated intermittent stream from the flag labeled"Al"to the flag"A2"and from the flag"AY'
(located at the breached dam of the old pond)to"A4". At flag"A5",the feature is also an intermittent stream and at
flag"A6",the feature becomes perennial. A form was not filled out for the"A6"reach of feature"A"because this
section of the feature was not in dispute.
This stream should be identified on any future plans for this property. The owner(or future owners)should notify
the DWQ(and other relevant agencies)of this decision in any future correspondences concerning this property.
This letter only addresses the intermittent/perennial status of the stream feature and does not approve any activity
within Waters of the United States or Waters of the State. If you have any additional questions or require additional
