PROJECT SUMMARY: This project is being done as a major modification to major permit # 10-08. As an amenity for lots 10 and 11 the applicant is proposing to develop two piers with platforms for observation only and a community pier/platform in- between lots 10 and 11, which will be used for observation only. 9. Narrative Description: The Pinnacle Point project is located at 1454 Oglesby Rd. Oglesby Rd. is found by turning east off of N. 20`h St. in Morehead City in the area locally known as Crab Point. The site is 409,303.01 square feet in size, and was previously used for farming and a residence. Within the tract, approximately 80,323 square feet or 19.2% is coastal and/or federal wetlands. This site is adjacent to and immediately east of the s/d known as Mariner's Point. Surrounding the property to the north, east and south is a tributary of the Newport River known as Crab Point Bay. The property averages 3' above NHW in elevation. The high ground portion previously housed a single-family home and an existing unimproved road and is currently a 15-lot subdivision. The southern portion is vegetated with typical lawn grasses, herbaceous weeds and coastal marsh. The western portion has an existing farm ditch which separates this property from the mariner's point s/d. Pine trees, White Bay, Sweet Gum and scrub/shrub habitat (Wax Myrtle, Yaupon Holly and Catbrier) is prevalent on the northern and eastern portions of the property, with both transitioning to coastal wetlands. The Morehead City zoning for this area is R 15M, with the property served by municipal water and sewer. The high ground development is currently being done but has not been completed at this time. There is a 50'fringe of Coastal Wetlands present along the shore adjacent to Dill Creek. This fringe contains Smooth Coordgrass (Spartina alterniflora), Black Needle Rush (Juncus roemerianus) and Salt Meadow Grass (Spartina patens). Within the waters of Dill Creek are large expanses of oyster rock. The water depths in Dill Creek are mostly shallow but according to the applicant and through field verification reach an average of -2.12' NLW within the channel portion and an average of - .55' at NLW at the landward edge of the channel. The substrate in this area is thick organic mud. This section of Dill Creek is a Primary Nursery Area as designated by the Division of Marine Fisheries and the Division of Water Quality classifies it as SA waters. The area in which the proposed project would take place is closed to the taking of shellfish. Morehead City's Land Use Plan dated 1999 classifies this area as Limited Transition and Conservation within the AECs. Crab Point Bay is approximately 989' across at the project location. The shoreline for lot 10 is 72', which is after the 7.5' easement for the community pier and platform is removed and the shoreline for lot 11 is 72', which is also after the 7.5' easement for the community pier and platform is removed. Extending down the middle of both lots is a 15' community easement. The riparian corridors are shown as property line extensions. Al other riparian corridors in the future will also be shown as such. 10. Proiect Description: The applicant is proposing as an amenity for lots 10 and 11 and the subdivision three- observation piers. The pier for lot 10 would leave high ground for 20' and then cross 55' of Coastal Wetlands and 45' of oyster rock before reaching open water. The pier would continue Field Investigation Report: RJP Newport Corporation Page 03 another 215' while weaving through a large expanse of oyster rock and intersecting to a 10'X 20' platform. The total length of the pier for lot 10 would be 300'. The pier for lot 11 would leave high ground for 27' and then cross 48' of coastal wetlands before reaching open water. The pier would continue another 235' while crossing large expanses of oyster rock and intersecting with a 10' x 20' platform. The total length of the pier for lot 11 would be 310'. The community pier for the s/d would cross 20' of high ground and 55' of coastal wetlands before reaching open water. The pier would then continue another 215' while also crossing expanses of oyster rock and intersecting a 10' x 30' platform. The total length for the community pier would be 300'. Information provided by the applicant and field verification indicates that the proposed piers are within 1/a width of the waterbody. The pier for lot 10 would extend 173' into the waterbody and encroach another 52' into the channel. The community pier would extend 180' into the waterbody and another 45' into the channel. The pier for lot 11 would extend 195' into the waterbody and another 50' into the channel. 11. Anticipated Impacts: The proposed docks would shade a total 960 ft2 of Coastal Wetlands and incorporate and shade 4690 ft2 of open waters. Large oyster rocks containing healthy populations existing along the shoreline would be disturbed during the construction process. A hindrance to traditional navigation would occur from the location of the proposed docks due to the encroachment into the channel portion of the waterbody. The Division of Land Resources approved the sedimentation and erosion control plan (CARTE-2007-434) and The Division of Water Quality approved Stormwater permit #SW8070507. The owner, RJP Newport Corp, is applying for 3 observation piers located on lots 10, 11, and the Community Water Access Easement between the two parcels for use by Lots 1, 2, and 3. The pier on Lot 10 will be 290 feet long with a 10 ft by 20 ft viewing platform located at the end. The community access pier will also be 290 ft long, but it will have a 10 ft by 30 ft viewing platform. The pier on Lot 11 will be 310 ft long, and will have a 10 ft by 20 ft viewing platform. All piers will be located within the Quarter Distance Line. The attached archeological assessment was performed by ACC, Inc in February 2008 on the entire tract.
