Please reference the Notification of Unauthorized Activity issued to you on July 21, 2008, for
unauthorized work you undertook within wetlands on your property located at 1767 Woolard
Road, near the intersection of Woolard Road and Horse Pen Swamp Road, adjacent to Latham
Creek, in Washington, Beaufort County, North Carolina. Also reference the site visit conducted
by Mr. David Shaeffer of my staff on October 16, 2008. The purpose of this site visit was to
conduct a final inspection of your restoration work.
Based upon Mr. Shaeffer's inspection, it is my opinion that you have satisfactorily completed
all remedial actions requested of you. Accordingly, no further legal action will be taken in this
matter and we consider the case closed.
Please be reminded, pursuant to Section 404 of the Clean Water Act, prior Department of the
Army permit authorization is required for the discharge of dredged or fill material into waters of
the United States, including wetlands.
Thank you for your time and cooperation in resolving this matter of importance. If you
